If the carrier is paying you that's who you work for.If you call your self a business the first lesson you need to learn is who is your customer,and if there is any doubt its is who pays you that's your customer.Guys who lease to a carrier your customer is the carrier..Knucklehead Thanks this.

No Sir, I must respectfully disagree completely because what you described is an employee/employer relationship. When leased to a carrier, you have entered a strategic partnership with them. An O/O is an INDEPENDENT contractor, not an employee. The distinction being that you are employed by yourself, you have chosen to partner with that carrier. Are you leased onto Malone? If so, remember back to orientation when they repeatedly told you that you do not work for them. They are not responsible for your well being. That includes fuel, maintenance, insurance, or even loads that you haul. Their responsibility is to provide the legal insurance, authority, maintenance to the trailer if leased, and record keeping required by the FMCSA. You are responsible for the care and upkeep of your equipment as well as providing the service that has been requested by the customer. BTW, the customer is who pays you, not the carrier. They send a check to the carrier once they have received the bills, but they are the ones who pay the agreed upon freight charges. Freight charges that YOU not the carrier have negotiated and agreed to, again not the carrier.

your really drawing out what is a very simple definition a customer is the person or organization that is paying you.your confusion of the trucking companies customer ias being your customer isn't true while yes you have a vested interest but only that there paying your customer..And your not in no way a partnership with the company you have an agreement which you have no say you agree to there terms or you go somewhere else.a partnership is 2 or more people running and contributing funds to a business which they are also share in the profits which they are not sharing profits with you are theyLast edited: May 28, 2017

Let's see if this helps determine who your customer is.Your leased to Malone you take a load for xyz pipe deliver it then xyz pipe goes bankrupt would you still expect Malone to pay you even if xyz didn't pay Malone?

In English please, attempting to read this is rather painful. If you believe that someone as an owner operator has no say in where they run, what freight they pull, or at what rate I would highly recommend you remain a company driver if you are indeed one. Good day sir, stay safe out there.

yes malone would pay you then they would go after the customer. because it is there customer . we get payed 1 or 2 times a week. malone gets payed per contract with the customer. which maybe every 30 or 90 days.

but yes whether you are a lese driver or ower operation. you do it your own way. at malone or at mercer they will let you make it or fail.it's up to you. that's just how it is.
