When I was a kid down in The South, back when we rode dinosaurs to work, it was common for the car behind the turning car to also activate a turn signal if he was slowing/stopping for a car turning in front of him so as to better prevent this sort of situation.

I might add, I had a similar accident happen with me 20 plus years ago in my personal vehicle. I was the black car. Only difference I wasn't trying to pass a truck in front of me. Merely the vehicle in front of me in fact I was half way around it when ####### turned in front of me. Guess who was still found at fault?

That truck is considered too close to the red car?

You can't necessarily use a camera to judge following distance... I use a camera also and when I review the clips I am nowhere near as close as the camera makes it look

To me, the truck driver was professional throughout the clip. He slowed to increase following distance [still further] the instant he determined the car was slowing. He never seemed to follow too close and never seemed to hang out closer to the left side of the lane like some do. Even tooted his horn to warn the black car the instant he saw what was developing.

Also, as far as a personal injury lawyer is concerned, the only person not at fault will be the person they're representing.

I don't know about other states, but in ND the black car would be considered at fault, and would likely be cited for passing when unsafe to do so.

Odd, my camera is the opposite. Like a convex mirror for distorting distances.

Looks a bit close to me. Everyone has their own idea of what's a good following distance but less than 2 seconds at highway speeds isn't recommended.

But there isn't. If you read the article it says that the passing vehicle would be at fault if it entered the intersection after the turning vehicle began the turn, which it clearly did so in this case. I'd also say the passing vehicle was at an excessive speed though not terribly so. So even if this occurred in Louisiana the passing driver was still at fault.

Either way this is just ridiculous. I can't believe ANY state would allow passing at an intersection like this. It's obviously unsafe and has absolutely no appreciable benefits.

Some of these comments make me wander where in the high blazes of hell did some of you even get your driver's licenses let alone your CDL... Under no circumstances does a passing vehicle have a right of way.

Passing more than 1 vehicle at a time is reckless in va from what I understand. But who knows about the state that was in. So, passing the truck was fine (and had the passing car cut in front of him all would have been good) but passing the red car after passing the truck is reckless. Precisely because of this potential situation.

Plus, the red car starts the turn while the black car is still 40+ feet behind him passing the cab of the truck.

    not4hire and mjd4277 Thank this.
