If the trailer ABS is not functioning then it brakes exactly the same as an older trailer that is not equipped with ABS. As noted earlier the law only says it needs to be equipped and to inform the driver when it's not working. When it's not working (i.e. light stays on) I just note the fact in my daily inspection report and roll on.

Oh, he definitely po'd the officer. Only reason I can see to get that infraction. Someone that runs an OOS order for a flat tire would tend to do that, even if he didn't verbally piss off the cop.Bwbibb Thanks this.

I think your right about it still bieng a violation.
I've been looking for something more concrete about it but I can't find it. It was mentioned by my carrier in a safety meeting so they may know some way to deal with it. I can't imagine them willing to eat points to keep a trailer on the road and ABS problems can be a frequent issue. The ABS computer went out on one trailer and it would have sat for 4 days waiting for a new one to come in...
10-4 Magazine had an Ask Law Q&A back in 09. But I think this is more opinion than fact and qute a bit has changed since 09.
CVSA put out an inspection bulletin that indicates it's a violation.
