I believe the ups driver is at fault, there is plenty of notice that the lane was gong away, however the dash cam truck could've slowed enough to allow him over.

I just had a breakthrough.
There is a State Trooper inside the little cones dividing the lanes on the far left of the trucker who now absolutely has to change lanes per state law to give right of way to a emergency vehicle on shoulder. -

Well, there is the rub. Literally.
I am not here to be a armchair quarterback. I would have blown the doors off that smokey and if he wants my hide bad enough he can come out of there and lasso it. I can think of really safe places for him to hang out at to be honest with you. They get into the worst places sometimes.
I feel really bad also for that pete on the far right. He did one thing right halfway by tossing in the towel and getting on the braking.
I would love to see the damage report from all three safety depts involved in this... -
No where in any fmcsa manual does it say for one to slow down in traffic and allow the idiot who's not paying attention Rome to move over.
Again, another one who is cherry picking my comment. Professionally, yes he should have but it's the ups drivers job to know what is going on and it's his job to know that HE is REQUIRED to SAFELY YIELD to merge into another lane. -
True doesn't have to. But guess what now he probably doesn't have a job, a wrecked truck. And he wrecked someone else's truck. Why? Because he had to be a d@#@. Real smart move.
