15mph warning

    My husband has been driving for 2 yrs. He got a warning for doing 15mph over and is now having a hard time finding a job. He is an Owner Op. Anyone know of anyone that will take him on and pay half way decent?

    A warning? Or a ticket? Warnings for 15 over are generally unheard of, especially if in a CMV

    He’ll find places that’ll take him, but can pretty much forget the good LTL companies and companies like Wal-Mart. 15 over is a no-no to most of their insurance companies...

    Yea, tell him to fight the ticket (I highly doubt it was a warning) and to slow down. There is almost no excuse to ever be going 15 over.

    Even assuming it was a ticket, and that was ALL the report showed, it doesn't seem like that alone would be a deal-breaker for many ... just sayin'

    You say he's an O/O. Why doesn't he just go to brokers for loads?

    I imagine she means he's leased to somebody and does not have his own authority, and assorted permits and insurance.

    He cannot plead down and take a driving school... this is Anti-Masking and is illegal

    § 384.226 Prohibition on masking convictions.
    The State must not mask, defer imposition of judgment, or allow an individual to enter into a diversion program that would prevent a CLP or CDL holder's conviction for any violation, in any type of motor vehicle, of a State or local traffic control law (other than parking, vehicle weight, or vehicle defect violations) from appearing on the CDLIS driver record, whether the driver was convicted for an offense committed in the State where the driver is licensed or another State.


    Regulations Section

    Serious Violations While Operating a Motor Vehicle
    • Speeding excessively, involving any speed of 24.1 kmph (15 mph) or more above the posted speed limit.
    • Driving recklessly, as defined by State or local law or regulation, including but, not limited to, offenses of driving a motor vehicle in willful or wanton disregard for the safety of persons or property.
    • Making improper or erratic traffic lane changes.
    • Following the vehicle ahead too closely.
    • Violating State or local law relating to motor vehicle traffic control (other than a parking violation) arising in connection with a fatal accident.
    • Driving a CMV without obtaining a CDL.
    • Driving a CMV without a CDL in the driver's possession.
    • Driving a CMV without the proper class of CDL and/or endorsements for the specific vehicle group being operated or for the passengers or type of cargo being transported.
    Disqualification for Serious Traffic Violations

    The first violation for a serious violation does not result in a disqualification. A second serious violation within 3 years, results in a 60-day disqualification, and a third serious violation within 3 years, results in a 120-day disqualification. Serious disqualifications must be served consecutively. All serious violations in a CMV are included. Serious violations in a non-CMV must not be included, unless it results in the revocation, cancellation, or suspension of the CDL holder's license or non-CMV driving privileges.

    It was only a warning, there was no cost or anything but it still shows on his record. We can't afford insurance or he would just go on his own. They want 9k down. We had some family issues and he took 2 months off. Didn't realize at the time how much that warning would impact him on going back.
