K&B Transportation: I Should Have Known Better

It turns out that I was right and that someone from K&B came and took the truck on Saturday. Keep in mind that I was EXPLICITLY told by the representative from the towing company (while seated in the state trooper's patrol car) that I would not be allowed to retrieve my items until Monday. ** This is to say that the state trooper was present during this exchange and that it was recorded by the in-vehicle camera system**
I called K&B, irate that I just spent $250+ dollars on 2 nights at a motel, only to be told that, "Your stuff will be in the brown dumpster out back."
Granted, I was not speaking calmly.
I tried to contact the towing company and they would not give me information about the driver that originally told me that I could get my things on Monday. I threatened legal recourse and they told me, "I don't give a #### what you do, #######."
In addition to this, I am told that my things have not yet arrived at the K&B terminal in Sioux City, NE, which is less than a trucking day away. Since the driver was sent by plane to retrieve the truck, and he picked it up on Saturday, I can only be lead to believe that they are dispatching this recovery driver on loads with my personal belongings in the truck.
I have text messages from K&B stating that they told the towing company to let me get my personal items.
The towing company claims that they were not contacted by K&B in regards to my personal items.
K&B also claimed to have tried to contact me to let me know this, but my call records show that I was not contacted by either K&B or the towing company after the time they stopped me.
Literally all of my clothes are in the truck aside from what I'm wearing and one pair of underwear and a t-shirt. I have a $250 sleeping bag in the truck. My Instant Pot was $100. I have easily $100 worth of books in the truck. I have items of a personal nature in the truck. My Red Wing work boots are in the truck. I have tools in the truck.
K&B is now saying that when my items arrive in their yard they will put them on a pallet and that I can arrange to have them sent to me via LTL carrier at my own expense.Last edited: Nov 20, 2017

This is now a divorce gone really bad...
I probably would have stopped the truck at the first carrier and have them begin work on the APU and not moved until it's fixed. The Company would be obligated to pay the bill.
As far as the stack of urgent and all the other stuff forget it. It will get there when it gets there.
The illegal running? Ha. Save it. You have the HOS beat into your head, use it. If they force or yell, then don't move because you ARE out of hours until the next day or reset etc. The new computer ELD's will make sure of that. Do not rely on it totally, keep a journal of all your activity.
Taking the truck home? Bad idea.
The poor communication with dispatchers? That is not a dispatcher talking, it's a enforcer making sure the load is delivered, hell or high water. I would have left on day one at my own expense.
As far as the rest? Ha... stressors yes. But ultimately you learn to discard it and hold on to the most important problem, the rest can be let go.
Its unfortunate.
When you are with a bad company with really bad people and everything is to worse.. then don't stay there a day longer. It is literally your life. And how you live it. Don't willingly prostrate yourself to be tortured if you don't like a arrangement. Its a tragic waste.
Ive had many companies that will write just like that story over the years, most of the time Im gone within 3 months. Move on to the next. I think of all of them (Excess of 50) there are maybe 5 or even the one in which it's totally worth staying the course with. To be totally honest with you
You taking their truck without authorization is going to go against you
....the only leg you could possibly stand on is the fact that refused to fix the truck and that's a safety hazard to your health.
You should've refused to drive the truck without heat
.....so tell us

As an employee you have certain rights when it comes to your health & well being .
Most drivers don't even know they don't have to drive if they are sick or for some good reason they didn't get enough sleep ( body clock issues)x1Heavy Thanks this. -

Next time a dispatcher is waking you up during your 10 you let him know he is not letting you sleep therefore you might not be able to get the load on time
...and by DOT law you are protected
And i bet they don't wake up anymore -
Believe me I expressed my discontent with their policies MULTIPLE times. It did nothing to stop them from doing it. In fact, it seemed to increase afterward.
