Can you book a load from a load board with your MC# and have someone else Haul it that is not leased under you? Like with their own authorities?

No. That would be considered double-brokering. Also, in every carrier contract I've signed, there's a clause prohibiting that exact action.
The only reasonable exception would be to hire someone to complete the load in case of breakdown or other catastrophic failure -
No.
As stated above that will make your actions like that of a broker. That's not legal.
You can be a trucking company or you can be a broker, but not both. Im pretty sure with my big mouth someone will come on here and tell me off that they hold both licensing. I recall one company in little rock that had a broker house whom I talked to daily. I quit after just two weeks. It's nuts. And I was supposed to do something totally different within the outfit. Im glad I quit and moved on. I knew something wasnt right....
Imagine if mega such and such can get a bunch of loads at a profit and then create even more profit shoving bad runs onto people who don't know better. -
Thank you guys! But I don’t believe they’re double brokering as they are still dealing with the brokers and think they are just finding the loads for guys on the road. Is there a difference there?

Back in the old days we did a thing called a trip lease. It was a little funky and largely died out with the demise of the ICC and deregulation. You could have someone else temporarily rum a load under your authority as a repower.
Brettj3876, x1Heavy and spyder7723 Thank this. -
I repowered someone's hazmat once up on a time when his engine block failed him. He was nervous as a well night lady in church until we got him to safety. Lucky nothing further happened and it became his goal to solve the problem there.nightgunner Thanks this.

Its still around today. Doing "3rd party" work in the oilfield we have to sign a trip lease agreement to be legal. Their equipment with our signs and dot # covering up theirs. Also considered a drive away-tow away operation exempt from eld mandatenightgunner Thanks this.

To my knowledge double brokering is not illegal unless specified in a contract.
Unethical maybe, but not illegal. Happens daily from what I read. -
It's sort of legal, but the liabilities are large.
We do trip leasing a few times a month with a few other fleet owners when there are breakdowns or they can't cover a load, it happens all the time. -
Double brokering from a load board. However, if you have a consistent broker then maybe you can work something out. The carrier I worked with worked with brokers that allowed double brokering.
