    I just read the article and my heart goes out to everyone involved (except Crete - hope they seek charges if they're guilty). It's so unfortunate there is so little recourse for truckers. I'm always telling my husband to "keep it legal" no matter what - even though we're both aware that he could be fired anyway.

    You know its funny how they left out the fact that the driver of the car was only 15 yrs old with no license! Would it have changed anything if an adult was driving, we will never know but I doubt it.

    It's also odd how they say he fell asleep when reports had show proof that he was on his cell phone just prior to the accident. They also stated that he had a dog with him.

    I am in no way shape or form defending this driver or crete, so please don't take it that I am.

    I read the article in the Daytona Beach News-Journal, and there was no mention of a dog or cellphone either - nor the car driver's young age. Hmmm, makes you think.

    I did some more research and found this article from 2006:

    There was an article back then about Crete and the way they were running him as well. It clearly showed the fault on both sides. I will try and see if I can find it.

    I know the company I am at tried to get me to run illegal on about 3 times. The third attempt, I told them I was bringing the load and the truck direct to the yard. I would not run illegal. It got their attention.

    He worked a plea testifying against Crete . He got off too light considering he feels he's being harshly punished for an accident . His violation of HOS was willful and deliberate . Maybe while he's sitting in his cell he'll find the verses in the Bible about obeying the rules of your government .

    That is the article. Crete knows when the trucks are moving. They match logbooks to the qualcomm location.

    As far as murder, that is a little harsh. He did not have the intent, so therefore the manslaughter charge is the level.

    I've got a couple of questions but I don't want anyone to take me wrong so please understand in no way am I defending the driver!

    How is it the family is sueing crete when they was allowing a non licensed underage driver pick up them kids? I know they lost their kids and have paid the ultiimate price for their lack of better judgement but should they have the right to win a big cash settlement?

    I also remember hearing reports that people in that area had concerns for that spot due to lack of visibility.

    The same reason the lawsuit is filed if a drunk pulls out in front of the truck and you hit them.


    Attorneys go for the big bucks.

    In this case, though, I do not feel that an underage or correct age would have made a difference. But then again, like in a truck driver log, if the underage driver had not been driving illegally, they would not have been there.
