Parking lot predator in Albany Georgia

    Yeah. Calling the cops can go either way. They may have run Mr boot off or they may have said fine..tow the truck and impound it, send the dogs to the pound and arrest the old gal until she can choke up the money.... Not that I've ever had a similar experience in Georgia in the late 70s or anything...

    It's private property and a civil issue so not much they could do other than see if the have a biz license and a permit to see if they are legit..doubt they were. Also could verify the who the owner of the property is. Sounds like a little crime ring they got running down there in Albany..no surprise there

    You can't have ANYONE arrested for trespassing upon your property when you 1) operate a business that is open to the public and 2) the person has no way to reasonably know he is not welcome. If you have asked an individual to leave and they refuse, NOW they are trespassing. If you have posted signs stating "no trucks", then they MIGHT be violating the law...but not necessarily. Depending upon your jurisdiction, YOU are the one potentially breaking the law if you have a vehicle booted or towed from your property without signs posted prohibiting parking which also provide the name, address, and phone number for the tow company. Just because you own the property doesn't mean you can have any vehicle you wish towed at any time.

    Trespassing laws REQUIRE that the individual knows they are not welcome there. Parking lot that is open to the public and a lack of signs means they ARE NOT TRESPASSING until you have spoken with them and asked them to leave AND they refuse. Don't like it? Pry open that wallet of yours and pay for some signs and post them at the entrances. Now you have a leg to stand on. Until then, tough $#!+. Boot my truck and I'll cut the stupid thing off, and there isn't a dern thing you can do about it. Can't have me arrested for trespassing because until I am asked AND REFUSE TO LEAVE, it is not trespassing under the law. Do I need to say it again for it to sink in? The person has to know they aren't welcome to be there and refuse to leave before they are considered to be trespassing. If you don't like me cutting your boot off my truck so that I can leave, take it off yourself...but I'm not paying you to remove it. You want me to leave, and it'll happen just as soon as I can move my truck. If you lay a hand on me, whether it is your property or not, it is assault and I have EVERY RIGHT to defend myself...so don't. It won't end well for you. That's not keyboard bravado, but fact. I do not take kindly to folks assaulting me, and my bite is a hell of a lot worse than my bark. I will defend myself, no ifs ands or buts about it.

    One more time since you seem to be a little slow: It isn't trespassing if the lot is open to the public and there are no signs prohibiting entrance to the lot...not until you ask them to leave AND they refuse. If you haven't posted signs prohibiting trucks, there isn't a #### thing you can legally do against the driver until you have asked them to leave AND they refuse.

    There does not have to be one.

    It is simple. If you do not own the land you better #### well make sure the owner is ok for you to be there. They are under no obligation to notify you. It is your responsibility to ensure you are in a safe, secure, and approved parking space. No one else has any obligation to do that simple job for you.

    The laws in Albany allow for them to do it. You would be in violation of the law, and in impeding an officer of the property from ensuring compliance.

    A vacant lot can not be open. So your flawed big boy theory is shot to ####.

    But hey you go girl. Be real funny watching another chicken head dance on the end of a TASER.

    Small wonder truckers are not welcome most civilized places.

    Dunno. Saying one should hide when they park where they should not and shoot the person enforcing that in the head........ sure sounds criminal to me.

    Very similar to saying if you decide to use someone's pool because they did not put a fence to keep you out, you should shoot the security guard they hired to keep you out.

    06driver I just don't understand what your stake in this thread is. I posted it to warn others not to fall into the same trap. Seems to me that is the same as suggesting they stay off parking lots in Albany Georgia. What else would you like to see happen? Have walmart take over the entire trucking industry because only walmart drivers are courteous and considerate of others as you are?
