Something similar happened when I was working for PFG. Traffic on I-95 north stopped because of construction, our truck stopped, with 4 ways flashing, and a car came up behind him and never slowed down. Ran into the back of the trailer at about 70 mph.

Not only that. But I'll bet every lawyer in the country will want to know why he stopped to update his logbook and charge his phone and why is he running logbook instead of eld. If what news says is true.

Depends on the MODEL YEAR OF THE TRUCK. If it’s a 1999 or older you can still run paper logs. Also,as I’ve mentioned elsewhere some of the ELDs used by some drivers are used via phone apps,as buying/ installing traditional ELD devices can be prohibitively expensive.
At any rate it was ALREADY DETERMINED that the truck driver wasn’t at fault. 4 wheeler FUBARed,case closed.Last edited: Mar 17, 2018

I'd like to see his log book. Updating what?all updates should have been made BEFORE he pulled out and again at his next stop,fuel stop,break etc.unless the shoulder of the rd was his next stop.maybe his eld said he had to stop.right then and there.then who's liable?

And the 4wheeler wouldn't have FUBARED if that semi hadn't stopped on the highway to update his logbook and charge his cellphone.That logbook should have been ready to go when he left. His cellphone should have been plugged in when he left. And now he's not going anywhere. Because his trailer needs the bumper repaired and some new rims.

In my mind, the car driver has 2 major strikes against him. First he hit a stationary object. Second he failed to maintain his lane.
