i have worked in various fields want to drive for a good company have been shafted because i complained to safety and hr directors who decided it was easier to replace me then do as their policies dictate. and the first admendment does allow you to speak you mind about any thing you wish, its not easy for companys to hush a person up tie them up in court is what will happen. thats why they have lawyers. but when companys are exsposed on the news then they cringe. if they can hack my ip address to find out who i am then they are in violation of the law. its called invasion of privacy

 

Actually the first admendment does not allow you to speak your mind about anything that you wish to--in fact the first admendment only applies to Political Speech, not just any old thing that you want to say(common misconception). BTW, invasion of privacy laws do not extend to the internet, this has been debated and established in courts--by using the "world wide web"(as in WWW) you cannot expect an atmosphere of privacy-you can base your case on anonymity but not privacy, they are not the same thing.

 

there is a loop hole if you discover that a person is hacking your system you can have them charged with id fishing for id theft. and you can speak your mind as long as you dont slander that means you have proof of what you speak.

 

Maybe so, but you have to prove that they stole your id, and why would you leave any access to your Id online anyhow?? Also, you had better re-read up the stuff that the courts have said about the first admendment--it has only to do with political speech, and no you cannot say anything that you want to whether you have proof of it or not. You can have proof of something and speak it, and it still can be slander. Slander is when you maliciously speak something ill or otherwise about somebody in an attempt to discredit his character or his integrity whether it is true or not. The slander and libel laws have nothing to do with the 1st admendment--they are seperate and they are neither national or federal in character, they are based in each state and differ wildly from state to state.

 

usx is a horrible company.what their doing to their solos is lower than dirt.if your thinking of working as a solo for them ,dont.they will screw you sooner or later!

The first amendment applies to all speech. However there are limits such as liable and slander. Also you cannot yell fire in a crowded theater (unless there is one) or incite to riot or violence, etc. Also the constitution does not grant rights, it limits the governments power to restrict the rights of the citizens. As a minister and local director for Child Evangelism Fellowship I had to learn a few things about the first amendment.

As for the employee/employer relationship- if the company can prove disloyalty, then they can terminate you for cause. Keep this in mind when posting although if you're not divulging inside information and your conduct could be construed as normal for your industry they may have a hard time proving their case. Of course as "at will" employees they can get rid of us anytime they want. They need proof to keep you from drawing unemployment.

 

You are correct in all except that if it is provable fact then it is specifically not slander. I can call you a child raping ex-con if in fact you served time after being convicted of child rape. If not then I am slandering you. Pay attention to what PreacherMan is posting because from what I've read of his posts on these subjects he is dead on. And the courts have concluded that their are many limitations on the concept of free speech. Many of which have been mentioned in previous posts by various members including Tim.
