I am not an attorney but I don’t see the appeal succeeding.
But stranger things have happened...... -
I hope he doesn't win the appeal, as he clearly shouldn't be driving a truck... meanwhile, the taxpayers will most likely pay for all of his continued legal fees and the attorney probably loves it.lovesthedrive and 48Packard Thank this. -
Well supposedly the driver THINKS the testing immediately after a crash was unlawful. Alas to the teachers that taught me to drive, I was told ANY police have the right to test you for drugs ANY time they want. If they tell you to pee right there in public, you do so with out hesitation. As hesitation may show guilt.
Even if the driver had the drug test removed. It wont change the fact he wasnt supposed to be driving. As well as could not handle the responsibilities of being a truck driver.Moving Forward and mjd4277 Thank this.
