    That's a good point. What if the automobile was stationary and disabled for more than a few moments before Werner came along and hit it full on? That would put a different spin on it, no?

    +1 it’s another nail in Werner’s coffin. It was Armydriver that first mentioned it above so I went looking for corrobotation and only found that one source.

    All the info out there seems to coming from a single press release that appears to be written by the plaintiffs lawyer so who knows how one sided it is

    Also find it interesting that so many are sympathetic to Werner. They have been the butt of jokes for decades about their safety record, hiring practices and violations etc. they didn’t come by their acronym for no reason. And now, when a jury agrees with the legions of drivers, still the drivers aren’t happy.

    Here, at our peak we had 4 trucks moving oversized loads that I dispatched and invoices myself while driving one. I can tell you I kept a close eye on weather forecasts and radar when I chose the routes yet Werner, with all of its resources can’t manage?

    Most people are smart enough to see this for what it is. Big company was involved so it's obviously their fault. Doesn't matter what industry, what company, or what happened. It's all about the money grab and it sets a horrible precedent no matter who is on the other side.

    Yes 90 mil is a big number but they’re a big company. I have to think I would get sued for a proportionate amount.

    We don’t know the truth about what happened here but what if trucks headed in the other direction tried to warn Werner of the accident ahead where a pickup truck was stopped on the road.....you see, to me it makes no difference the pickup came through the median....IF the pickup was stopped. what if trucks hollered at him to slow down but because if a stupid no CB policy he was oblivious. and what if the driver called dispatch and said he wanted to park but they said press on or you’re fired?

    Again details are sketchy with no mention of compensatory or punitive damages but I don’t believe Werner was 100% at fault here either. It was probably more like 50% or 75% and they are paying 90 mil of 180 mil damages. I’ve had Ins companies tell me even if o did everything right, I Still assume some responsibility just for being on the road. If the above assumptions are correct, and if there was a trainer asleep in the bunk, I absolutely see how they found Werner 50% at fault.

    Regardless, Werner won’t pay but a fraction of this 90 mil after appeal

    Werner teaches new drivers from day 1 of trucking school all the way through orientation and safety briefings, dozens and dozens of times before we ever take our first trip with our trainer, that the company will never force you to drive when it is unsafe, and if they do then you can call werner safety and dispatch will be fired. The driver determines whether or not it is safe. Nobody else. Not even the trainer can over ride a trainees judgement not to roll.

    Outside Martinsburg WV last year, a truck blew a steer tire, crossed the median and hit another trucker head on.
    According to liberal/socialist logic, the fault is the guy who’s tire didn’t blow. If he had stayed home that day, the other guy wouldn’t have hit him.
