    My deepest condolences to the families of the deceased, and everyone involved, including the truck driver and his trucking company.

    This is a truly horrendous tragedy.

    However, in no form or fashion can or should the truck driver be held responsible.

    Had the truck traversed the median the litigators would have a foot to stand on.

    If we had NO COMPASSION, the litigators should be sued for all the reasons they list for holding "the driver" at fault. The lawyers and law firm that tried to blame the victim and defraud their insurer should certainly be sued for defamation and costs incurred by the truck driver and trucking company in defending themselves against such a ludicrous travesty of justice. Plus punitive damages

    This ludicrous judgement creates a PREPOSTEROUS precedent: even when the truck driver is a VICTIM he or she will somehow be found guilty and/ or at fault.

    In reality, with some COMPASSION and BASIC HUMAN DECENCY, it is very clear that no-one was at fault.

    EVERYONE SHOULD HAVE STAYED HOME. Had they "KNOWN", I am certain that they would have.

    Weather Forecasts are wrong at least 50% of the time.

    If inclement weather materializes along our route, EVERYONE should get off of the roads as soon as possible. Unfortunately this is often easier said than done.

    Some accidents are unfortunately ACCIDENTS. No-one is to blame. Nature was to blame. Nature cannot be sued... but needs to be RESPECTED.

    Lawyers and Law Firms that try to pervert justice by litigating, defaming, and causing irreparable damage to victims and their reputation certainly need to be countersued for costs, damages and a punitive component.

    EVERYONE involved in this accident was a victim. My condolences to all. They all need the HAD BAD experience Teaching Models/ Counselling Tools, (a Grief Counselling Tool), free on the internet. Most probably survivors, and the families of all involved also need GRIEF COUNSELLING and COMPASSION, not litigation.


    I would hope that the trucking industry come together to defeat this ludicrous ruling... and take it to Appeal.

    Congratulations on your first post under this user name.

    Based on what little we know of the details, I think all here agree the truck driver should not be at fault for the accident or liable in the civil suit.

    We know he wasn’t charged by the police. Can you provide a source beyond speculation that shows the driver was named in that 90 million suit? Or another separate suit?

    Why would the driver sue? It would cost him attorney fees along with the fact he didn’t get sued, Werner did. Chances are the driver no longer works for Werner and is working somewhere else now.

    If trucks have to shut down whenever there's ice on the road from now on, nothing will be moving through Wyoming between October and April.
