Time Card Exception to log book and Air Miles

    Hey guys, just to tell you something, this is govern really by the states and the states for the most part on hourly employees don't have exemptions on breaks and lunches for drivers, you get two breaks and one lunch during a working day by state law.

    Search the past threads where you've tried to pass of that same BS, and myself and others have repeatedly corrected you. The 12 hours have NEVER been broken down as you've indicated, and you regurgitating the same BS spewed by others who simply didn't know what they were talking about (or perhaps they were dumbing it down for folks who really needed a reason to believe something is the way it is)...either way, they weren't correct and neither are you.

    If you think you ARE correct, find something...ANYTHING...from the FMCSA, ICC, or any other official government agency that currently or previously regulated this industry. If it exists, FIND IT!!! I'll save you the time, though, and tell you you're wasting your time searching because it DOESN'T exist.

    Until you show proof that your assertion is correct, I'm going to continue to call you out on the BS you're trying to push as the truth.

    It is real simple regarding meal and rest breaks regarding interstate commerce. Currently only California requires them for drivers engaging in interstate commerce. And then only for drivers that are domiciled in California. The other states do not and honor the Federal preemption from time and wage laws as they should.

    Now, some local drivers that do not engage in interstate ommerce may, repeat may, be subject to state labor laws that require meal and rest breaks, however in that case then they would not be subject to Federal Motor Carrier Safety Regulations and therefore that requirement would not affect the Federal short haul exception.
