Going West on Highway 40.. very busy friday morning ,lot of trucks and cars on the road- three lane. I was on the Middle Lane . And the traffic is very busy about 100 foot in the front of me- basically everybody's flying at the estimate speed of 65 -80 mph, group of cars come behind us rushing, one of them tried to pass a slow-moving vehicle in the front of him on left lanesl, he tried to pass by driving on the shoulder at high rated speed he lost control cross infront of me- the Middle Lane and Crash int right lane guardrails. Luckily he didn't touch my truck . But I was pulled over accused of hit-and-run they say somebody give them my truck infor and the police just got took my information and did not issue any citation I should be concerned?

Uh....yes! Hope you have a dashcam or a witness on your behalf or you may be in for a hell of a mountain of stress, at least in the short-term. Good luck...
alds, NavigatorWife and James122 Thank this. -
Hit and run, but there was no contact? Am I missing something?
D.Tibbitt, NavigatorWife, tinytim and 4 others Thank this. -
Post an ad:
This areas Local paper; "special notices" - in the want ads section.
"I am Looking for witnesses to the accident in front of me - driving my truck - which was not involved.
Westbound on highway 40, Friday, (ADD DATE,) morning. I'm a bystander, and being unjustly accused.
Please call - *** *** ****."alds, NavigatorWife, deathB4decaf and 3 others Thank this. -
There was no contacts but I noticed the police was looking for scratch on my truck . when the vehicle cut infront of me- an effort to avoid colliding with it, I change to left lane for few seconds and everybody is running away from the accident and so I was focusing on avoiding any kind of collisions. The trooper say they're going to check the highway camera around see if they can spot the accident. they stopped me -like a hundred miles away from the accident,I didn't stop because there is no reason for me to stop, I wasn't part of the accident. If they think I was guilty why didn't they issued citation? I wonder if anyone face this kind of issue before.

If you gave a statement that you just avoided him, and they found no fresh marks, you may be good.
Best part is no citation. I would place the ad - for an Ace in the hole, though. Just to be sure. Can't hurt.Tb0n3, alds, NavigatorWife and 1 other person Thank this. -
Are you accused of hitting the out of control vehicle or someone in the left lane when you were focused on the out of control vehicle ...
rolls canardly Thanks this. -
No citation you should be clear. No worry.

"They say somebody give them my truck infor..."
This means that somebody may have called 911 and reported you. You can call the county sheriffs office where the accident occured and get a recording of the person that reported you. You have to know the exact time period and they can email you a sound file of the call.
By talking to the police a 100 miles away they probably were able to get you to admit to being at the scene of the accident. IMO, I wouldn't answer any more police questions and if you end up getting a ticket/summons, call the interstate trucker legal services or TVIR or one of those other services and get an attorney.
I got pulled over 9 miles away from a hit and run and was issued 2 citations. The cop examined the side of my trailer and then asked me if I had been on a certain road. When I didn't answer, he told me "there was a witness" that saw me take out a stop sign, a fence and some trees.
It was Friday, I was able to get the recording of the 911 call Monday which proved it was a different trailer license plate etc. I hired an attorney to show up in court, private investigator ( strikerpearce.com) to run the plate, reorganized my work schedule so by the time I had proved my innocence it cost me close to a thousand bucks.
And then I had to go to the state and have them take the tickets and accident off my record. It was a pain.
Also there was a newspaper article that said I was involved in a hit and run.
If you talk to the police, the information you give them can be used against you.

taodnt and NavigatorWife Thank this. -
Well they could still issue a citation if the investigation is ongoing. OP are you SURE you didn’t actually hit someone? I mean even a tiny scratch? It could just be that someone behind you thought you were involved. It could have easily appeared that way if the accident happened in front of you. I wouldn’t worry too much.
NavigatorWife Thanks this.
