Are you saying that his parent's could be held liable and sued because there 25 yo offspring hangs out with them every week or so and stores some junk at their home.

I assume to much..I assumed the casual manner of my writing and attempt at humor would be taken as one persons opinion rather that Object fact...Thats me I choose to live in the real world. A placed filled with varied sensory inputs, a few megatons of opinions and a little fiction called fact....

 

It does get a little complicated at times. I know with rental property, the landlord has exposure for renters.

I have some doubts about the liability of a son living rent free with parents exposing them to an incident of the sons due to his employment and might happen 1800 miles away. I think even a greedy attorney would not attempt it.

 

Actually, I'm not making any statement of what the law, a lawyer, courts, etc., would determine the residence to be, or not be. My comments are centered around IF a claim were to occur, whether or not insurance coverage may apply. The parents insurance policy isn't what is triggering or determining the liability, it's what would protect their assets from a suit if it were to occur. I'm not offering up any opinions on claim probability, severity or frequency. I'll pass on the rest of the discussion.

 

A friend of theirs was sued after their Adult (19) Daughter while living away from the home at college injured someone badly who was walking out of a door while she was riding a bicycle on the sidewalk.

Maybe that story will tell you why my parents are paranoid.


In your story the adult daughter (19) was away from home attending college. In this case the daughter is still considered a dependent of the parents, they probably claim her as such on their tax returns, and therefore covered by any insurance they carry. This gentleman is 25 years old and not in school. His parents cannot claim him as a dependent even if he were living in their home unless he is disabled and unable to provide for himself so I would think that there wouldn't no liability to them were something to occur.

But to get back to his question. It's not that difficult. My husband and I did it for a couple of years because we wanted to save for a home and since weren't "home" for more than a few days a month it didn't make since to pay rent on a place that stayed empty most of the time. Federal law now requires a physical address in order to obtain a PO Box. You also have to have a physical address to be employed, get a driver's license or anything else. For the first year we used my husband's sister address in TN (because they don't have state tax). After the first year we purchased property in AZ, however that property was remote and their were no street names (the so called streets are dirt roads, it is totally off the grid). We gave the post office in the nearest town our physical address, Parcel No. XXXX Area No. XXX. That's all they needed to give us a PO Box which became our mailing address. Our hometime was spent wherever we decided to stop until we purchased an RV and moved it onto our land. Then we lived in it for another year until we had enough money saved to build our home. As for the per diem, our tax professional told us that we were allowed use all days that we were "on-duty" as OTR drivers. The PO Box is our mailing address and it is the address we use to this day because no mail is delivered to our home and according to the PO it never will be.

People want to make things so complicated. He should be able to use his parents address to obtain a PO Box with no liability to them, however if they are seriously objected to this for whatever their lame reason is then he needs to find another alternative. This seaching for someone to share the "rent" with is not the answer. He could suddenly find that he's stuck with back rent and hefty utilities cause they ran out on it with him 1000 miles away. Stay away from strangers. Just find a friend who will let you use their physical address or you could possibly use the physical address of the terminal you work out of.

 

In loco parentis is not an issue with a 25 year old adult. As an adult the only person responsible for his actions is him. The thing with the 19 year old was because she was dependent upon her parents since she was away at college. This is not the case with him. His parents have an unfounded fear.

You vouch for that service? I booked a hotel through travelocity once, great rate by itself, but found at the hotel the walk-in rate was cheaper!

I just checked hotels in Nashville and that service has the lowest rates but the selections are limited . They only have 12 hotels in Nashville . The 2 closest to where I want to stay are near a railroad and received poor reviews . My wife decided to book a $147 a night Holiday Inn Select .
