Her day ended at 2 pm. She should have taken a 2 hour break. Then she could have continued. Under the split sleeper rule.
Since she didn't. She remained in violation until she parked the truck...period...end of story.
If you wish to double check this. Simply download a trial version of Drivers Daily Log...install. And run it under the perimeters you have given us.
It will clearly show you, WITHOUT question. Where and when she violated the rules.
The software is designed for truckers, and accepted by the DOT. -
10 Off-Duty = Clean 11/14
3 Dv + .5 On-DY + 8 SB + 8 Dv + 2 Off-DY + 3 Dv = OK
The time on both sides of the SB must not exceed 11/14.
10 Off-duty = Clean 11/14
.5 On-Dy + 6 Dv + 2 Off-Dy + 2 On-Dy + 3 Dv + 8 SB + 8 Dv = OK as time in front of 2 hours off duty dropped off with 8 hours SB.
4:45 - 12:00 AM = 7.25 hours on-duty
7.25 + 2.25 = 9.5 hours on-duty
9.5 On-Duty (8 hours in SB stopped 14 hour clock) + 8 hours on-duty (10:15 AM - 6:15 PM) = 17.5 hours on-duty with 735 miles of driving time (350 + 385)
No she is not OK, she required 10 hours off-duty to reset the 11/14 hour rule.
Be safe. -
HoS rules are based in theory. So that is how 99% of us log. In theory.
Quoted from Peterbilt 369 from last year -
Danc694u is probably correct but the person posting need to show how many of those hours were on each grid line to determine the correctness of the RDS.
from a retired federal DOT official -
I think the biggest issue that he and his friend has. They've never run through the night hours. And are thinking "day to day" when they consider the HOS rules.
IE They pick up extra hours at midnight. Because it's a new day.
It cost me well over $500 to learn the HOS. But you can bet I made it a priority the second time I had to sit for 48 hours, under the old rules
I don't even want to think about how much it would cost me now, 20 years later.psanderson Thanks this. -
Since there is now such software as DDL, there is no real need to not understand what is going on versus the old way.

Thanks Y'all,
