    Well he said he didn't know the car was there, so I think we need to give him the benefit of doubt.

    I didn't read anything about a citation either.

    No citation = honest mistake.

    equal at fault, it would be nice if the judge threw this out. It would be better if the trucker could prove this wast first time mercedes had done this wreckless driving.

    Good question. Let's suppose the trucker didn't see the car, but had a sudden loss of "power". ####, did my turbo just go out on me????

    He hits his four ways and starts looking for a safe place to pull over, doing his best to keep up to freeway speed with the hammer down.

    That scenario makes sense to me.

    I have watched hundreds of hours of truck crashes. Physics fascinate me. If a car sneaks over on the front of a truck they get into a voluntary pit maneuver, except they get stuck sideways on your bumper. Some videos that "pit maneuver" is so gentle I can imagine a trucker not noticing anything except an inexplicable loss of power. If the top of the car is under the line of sight of your hood, all you might see is smoke from their tires out your rear view mirror.

    "####, did something freeze up and my belts are going!!!???"

    Freeways in major cities are a study in sensory overload. As mentioned earlier in this thread, the correct action to avoid this incident was to wait to merge AFTER that entrance/exit ramp ended, THEN double check your mirrors.

    This kind of incident is also why I HATE driving a truck that doesn't have good, well aimed globe mirrors out on my hood.

    "Your honor, after the Plaintiff swerved into my client, without his being able to see the Plaintiff, my client felt an immediate loss of power. Out of concern for public safety my client engaged his four way flashers to warn the public of his predicament. Only AFTER coming to a safe stop off the lanes of travel did he realize that the Plaintiff was a brain dead idiot, that tried to prove the laws of physics don't apply to hin.

    I move that because the extent of injury to the plain stiff was a bruised pinky and soiled underwear, that plain stiff should pay my client one million dollars!!!"

    Because he knew something was wrong, and was trying to get stopped in a safe place. Looking at the diagram, I can see how it "could" happen. The Mercedes driver thinks he has it, 5he truck driver doesn' realize that Mercedes driver is an idiot. Who tried to cut him off from a blind spot. Ig the driver didn't see the car in the first 2 seconds as it turned in from of his truck. Then he wouldn't see it till he stopped and got out. As someone who is in residential neighborhoods all the time. I can tell ya cars disappear from sight all the time. QUICK
