HOS violation

    IF they weren't going to let me stay, I would have just driven off with the loaded trailer and returned when I had the hours. IF they wanted the product, then they can let you drop the trailer and bob tail to the truck stop.

    I think this is the most professional and diplomatic solution to resolve my issue. I will try this next time as an alternative to a violation. Keeps me out of trouble with both DOT and my employer...providing I let my company know my plan.

    actually had this dingbat tell me if i did that she would call the cops (as if i am stealing her freight in my truck), or they can block you in

    or worse yet, they can actually file a claim with your insurance company for failure to deliver the freight

    the ball is stacked in their court

    many times, the shenanigans that some drivers get away with regarding the receiver acting like a real piece of poop, the drivers happen to be lucky the issue wasnt truly pursued

    i have found out, we have little legs to stand on

    but sometimes, a good fight will give you a good win

    pick and choose your battles wisely

    Roadmedic, not to move away from the subject which is till on the hos subject. I dive out out of my HOS 2 or 3 times a week not because I’m dedicated to delivering my load but because after delivery I’m usually 3 hours out and in a day can. I was told by my district manager to go on duty not driving. I am female and not sitting on the side of the road all night being it is a day cab. I have never received a ticket for violating my HOS. I would like to find out how pricey they can be so I can tell them to kiss my ###. I am an oilfield driver and they insist that the HOS do not apply to us.

    Violated? Fine. In comments, kicked out by customer.

    I have never ever had a shipper or reciever give a #### about my HOS situation. That is one of the biggest problems in this blessed industry. I don't worry about HOS, ELD or Paper. It does not bother me. But it must change the culture of the not respecting the professional driver picking up or more particularly delivering the load.

    There have been times in the past I'll park it 2 hours from Customer. If they want it tonight, they come get it. Otherwise see them in the morning.

    The rules are slightly different with oil. Might do a google to find them. I've got a link but the author apparently isn't up to speed on the current 34 restart. It's dated November 2017. And I"m not sure but I think there's some state rules also. I could be wrong though.

    You might ask your question in the oil hauling category on this forum. They could give you the full scope of things.

    The rules are also different for ag haulers. Instead of the 100 miles. We're allowed 150 miles. No eld required.

    Oh yea! I remember when I posted this... it's an old thread revived from the dead!
    When this occurred I was a first year OTR driver. The HOS rules were different at that time. I got an HOS violation because I was over on my 14 and drove 5 miles to a nearby Wal-Mart and parked it.
    Hindsight is 20/20, but looking back I wish I would have just dropped the trailer in their door and bobtailed to a safe parking place and came back for it later...
    Now I'm in a day cab so I don't have to deal with this type of problem. From what I understand the PC rule in the HOS regs was revised specifically to prevent this sort of thing from happening. So you can now log personal conveyance to drive to a safe place and park, even if you have a trailer that's loaded or empty. I think that's a great exception for drivers on ELD's! Why did it take so long for them to revise it??? Wait....stupid question.

    Can you take the 16 hour exemption for local? There is a few criteria for it.
    1. Cannot have been used in the last 5 work days, or since reset.
    2. Start/stop same location everyday.
    3. Drive time does not change.

    That might be an option for you.

    As for logging on duty, not driving that is log falseifacation. Can be put oos and get fined for it...
