It is allowed for a carrier to charge lease operators for the cargo liability. The carrier is required to maintain the liability policies in their name. However no GOOD company charges this back to the truck owners. That says a lot about the company this person is leased to.

I m working out a plan to attract a third driver ....I think it will look like this
250 a day min (bonus over 6k revenue at 25%) current driver avg 1750
Dedicated loads 2/ 600 to 700 mile loads out empty back to plant
2 week paid vacation
Xmas bonus usually 2000 min
And pay half of med ins for driver

While that's true in most cases, there are exceptions, one is how you manage the driver and how they have a percentage of control of their job.
Most 1099 carriers suck, they do it all wrong, they think that they can control the driver in what he can do and can't do but that's wrong.
The IRS IN EVERY AUDIT I have had so far, has said that the 1099 scheme I have setup passes all of their requirements, and it also passes the DoL requirements - the IRS is not the arbiter of deciding if it passes labor laws, they just care about the taxes.
I have to correct a term here, the word cargo insurance doesn't apply to general good, but house hold goods.
The freight liability insurance is the right term.
BUT I can't find anywhere that says the leasee has to pay for or can be forced to pay for any freight liability insurance when the carrier has the exclusive obligation to maintain that insurance.
This is like telling a leasee that they also have to pay for the BOC and any other carrier obligations.
BUT no good company will charge any leasee back for this as you said. -
Just out of curiosity, what made you decide to go 1099 with your company instead of W-2?

A non driver that buys a ratty old truck, doesn't take care of thier employees( or non- employees), and wants to sit back and take in the dough. Where do I sign up?

Maybe your mistake is not putting that old truck on a lease purchase plan. Those seem to draw suckers nicely.
