I worked for Palmentere Bros, in Kansas City, MO, for 8 month. Everything that I am writting about was put on the computer, until I got to the hospital. On February 20, I was having sever headaches & chest pains, but all they cared about is that I was not late delivering the load. I was not late, but I was still in pain. Then on February 26, I woked up having speech problems & lost the feeling in my right side. Since my phone had no signal, they would not call an ambulance for me, but they rather ask a driver that worked for them take me to the nearest hospital. My CT Scan showed, I had a blood clot in my brain & that I had suffered a stroke. When I told them what had happen to me all they cared about is where is my truck. They never called my family to them what had happen to me, the hospital had to called my family. When I got released out of the hospital, they would not let me get my stuff out of the truck until my family came or someone from the company came & clean it out. On March 3rd, my family came, thats is when I had found out that alot of my valuable were missing(about $500). When I contacted that driver who took my keys to secure the truck, he said that he was told to by Palmentere Bros. to take them out, but when I called them, they denied it. When I started working for them, they took this money out of my paycheck in the first 90 days: $400-security, $100-motel & meals, $100-physical & $144-bus ticket. They said that after 6 months of employment that for any reason I leave, I will get this all back. But, here is the kicker, I am now disabled & I being charged with abandament of equipment. My check was only $3. I called them to find out where the rest of my money is at, I can not get a straight answer. I just need to know, what can I do now & if I am qualify to claim worksman comp, disability or do anyone know a good lawyer? Thanks, Snohawk!

In order for you to get workmans compensation, you will have to be able to prove that your trucking job caused your illness or disability. Considering that you had a stroke that will be difficult. If you have been working most of your life on the books and paying taxes, you should be able to qualify for disability through The Social Security Administration. Contact you local office and file a claim. If they deny your claim, get a lawyer who specializes in dealing with disability claims.
Getting back your lost wages will be difficult. The company is probably going to say that they deducted from your wages for towing, storage, cleaning and etc... Depending on how much money you feel you are owed, you might want to get a lawyer to help you get your money back. If you are only talking about $400-$500 dollars, you might find out that the lawyer fees are higher than the amount that you are owed. And therefore, not even worth hiring a lawyer. If you live near a university that has a law school, you may be able to free or low cost legal help from them. Or you check to see if there are any legal aids in your area.

I'm not a WC Lawyer but he does have a DOT Medical card that says he was fit to drive, and then he had a stroke. I have heard of drivers getting WC for stress let alone for having a stroke. If you are DOT Qualified to drive then how can they say it is pre-existing?
But I do hope the Op's post is a warning to other drivers that if you are over 40 and get chest pains or weakness in your extremities you should be checked out ASAP. This driver is lucky to be alive and the injurys might of been midigated with earlier prompt action.

A stroke occurs when a blood vessel that brings oxygen and nutrients to the brain bursts or is clogged by a blood clot or some other mass. How does trucking prevent the flow of oxygen to your brain? -

Very sorry for you situation and I wish you the Very Best in your recovery. As for the disability/workers comp issue the overwhelming majority of people are going to tell you to get a qualified Attorney and that probably is the best course of action. You will not only be up against Government Attorneys but Lawyers from your own company who are all looking to protect their best interest and could care less about yours. You need someone to protect YOU!!! Call the Bar Association of your state and ask for an Attorney referral. Most states will take a brief description of your issue and match you with an Attorney who specializes. Consultations are usually free or of minimal charge. Best of Luck!! -

Not all strokes start in the brain. Your driving along and a blood clot moves from a extremity to your brain causing a stroke. Sort of like what happened to the News reporter in Iraq except I think his clot went to the heart. Clotting problems have been found when a worker is subjected to long periods of driving and may have other risk factors
If the company coerced or blocked the driver from seeking medical attention I would get a personal injury lawyer. Depending on the facts they might even take the case on a contingency basis.
