Two Tickets From MTO What To Do

    Good morning everyone Happy and prosperous new year to you all,I recent last week got two tickets from the MTO 1) failure to go into weigh station in St Catherine's once the lights were on for $390 and also another one for failure to produce log book for $240

    my question is are there demerits points involved here and should I fight the tickets or just go ahead and pay them
    The court is in Welland Ont.our offices are in Mississauga I would have to take time off work to challenge this.

    Dont think there's any demerits points but there will be CVOR points. Did they ask you for your log book and you refused or just didn't have one. Also were the lights on or not do you have a dash cam to prove them wrong?

    The officer asked me for pretrip inspection report but it was at office The lights were on I had no dash cam I know i'm at fault.i'm just wondering what the consequences are

    Well a pre trip and log book are 2 different things the fact you couldn't show him your pre trip and he charged you for no log book you may be able to fight that one as far as blowing the lights I doubt you would have a chance on that one. But if I were you I would fight them when you go to court you may be able to make a deal with the crown they will probably throw one ticket out if you plead guilty on the other

    The points are there to stay, all you can fight for now is the reduction of ticket cost. It is a really dumb system that way. Cvor points I am referring to. Nothing against personal abstract, I don't think not entering open scale is a moving offence like speeding would be.

    Are you sure the points are there to stay. I'm from Ontario and could never get how that cvor point thing works but I thought if they gave you a ticket you could fight it if you won there would be no points

    Don’t think blowing the scale Carry’s any points it’s a failure to pay attention to signs or some thing like that. It’s a one time fine and a level 3 inspection

    And as far as the log I want to believe you risked running it because you didn’t have a log book.
    Not having a pre trip form filled out isn’t required anymore as in like 2 years ago.

    Post a picture of your violations found. Anything on there “ failing to provide current duty status”?

    Ya but if he's with in 70 miles or something like that from his home terminal you dont need a log

    I didn’t read all of the posts but. Even If he’s an otr driver but, only doing a local run still needs a log book otherwise he’d be on a time card. Something has to be able to prove when you started work.
    Curious what his violations show
