So, he signed on with this company as an independent sub-contractor, supposedly. Certainly there must of been some sort of contract he signed detailing the terms of payment, etc?

I would not say a word to the company, file with the labor department, then call the IRS, someone will collect your back pay and taxes for you,truckdriverslave82 and TripleSix Thank this.

thanks for all the replies. the company finally paid me. thank god i didnt have to go through this headache.
i called the state labor board. they will get you your money but only at the states minimum wage for only on duty and drive time only. they will not pursue detention, layover, percentage pay etc. so that wouldnt work for me. this will work very well for an hourly company or bus driver etc that has proof of there hourly wage.
This was my only option. If anybody has to go through this make sure you have a pic of the companys ad, copy off all your txt messages from dispatch, rate comms, dot #, signed bol by you, all the proof you need that you did work. I dont know about the other states but here in fl you pay the small claims fee and if the judge finds the company at fault they pay it. still a headache though.Last edited: Mar 27, 2019

I’ve taken companies on for less than a days wages. Once they have a target painted on their ###, they think twice.
Judges, the IRS, and Labor take a negative view of people with a history. But someone has to start that history. Otherwise the burden will be left to the next person.truckdriverslave82 Thanks this.
