Owner Authority Question

    Ok. I'll try to explain this the best way I can. My husband's an owner operator. He's considering partnering with a cousin who has his own DOT#. He's only been an Owner Authority for 6 months and he's manipulating his driver logs to stay on the road when he's supposed to be resting.

    I think it's called 10-hr break or something. What are the risks and penalties for violating the law like this as an Owner Authority? Should my husband partner with someone with so little experience? I told my husband he should not get involved.

    What year is your husband's truck? Do you have Authority or leased onto someone else MC?

    First, stay away from business with family, it is always a bad idea. Second, is it the cousin that is manipulating the log book or your husband? If it is the cousin, and your husband runs legal, I bet the deal will fail quickly because the cousin will expect him to run the same way, illegal.

    As for penalties, the fines can be anywhere from $250 up to $11,000 per violation, per day. The higher fines are for whoever owns the operating authority (MC Number), if they did not stop their drivers (including leased on owner operators) from violating the hours of service. Also, if your husband were to get in a bad wreck while cheating the log book it could mean the difference between a felony charge vs. a traffic ticket. Even if he wasn't at fault for the accident, because his logs were false he would face criminal charges and probable jail time.

    Oh, yeah. Run away before it’s too late. As a new owner operator with my own authority for almost one year, I have never in my entire trucking career been stopped so many times for DOT inspections (level 2 and 3 mostly). That plan is not sustainable.
