Ok after reading all of this. I have to agree with the others. You have no case. Lets see why.
A: TN is an "At will" state and that is where the company HQ is.
B: I would bet you signed a sheet of paper saying that you where informed of this and agreed to it.
C: You chose to take a dog with you.
D: I would bet you signed a sheet of paper saying that at no time dose the company take ANY responsibility for the animal and that at NO TIME can you blame them for anything that happens to the animal.
E: They gave you a way to get home. The fact that you chose to not do it is your problem.
So as any smart person can see. You have no case.

As far as getting an attorney, it would most probably be 'on retainer", not on contingency. This meaning, the plaintiff would have to pay up front for the attorney's services, since the outcome would be problematical at best. I doubt that the average driver can afford such an expense. Unless Krdog can afford such an expense, he would then have to find an attorney or someone organization that would take the case 'pro-bono' (free). My advice would be to chalk it up to a bad experience, move on, and learn from this. I went to one year of law school before I ran out of money to complete law school, so I know a fair amount from whence I speak. (now I'm a driver just like you all). Regarding shutting down when road conditions get bad; I shut down if I decide the road conditions are dangerous! I don't want to be one of those drivers that ends up in a ditch because I feel intimidated by the company I work for ! We as drivers, are compelled by FMCSR regulation 392.14 to discontinue operation of the motor vehicle if conditions become sufficiently dangerous! I don't allow company policy or intimidation by other truck drivers to sway my decisions. Until we, as drivers, stand up to these sometimes aggressive companies, they will continue to push push push-all the while spouting off "we care about safety".

I'm wondering what the first year mistakes were? I never had a company hold it against me for shutting down in bad weather. But it took a lot to get me to shut down also. I am not trying to puff out my chest, but I don't really remember making any "rookie mistakes" or any expectations thereof. Back when I started you were expected to be professional and do the job. Back then I didn't have a GPS or a laptop with a mapping program. The company wouldn't send me the route to take. They give me an address and phone number and I would call the customer and get directions. Then when I got loaded I would look at my atlas and figure out how to get from Point A to Point B. I was expected to be ontime (within reason) and be safe and not damage anything. What's so hard about that?
Seems to me like the newbies are fed this expectation of the best driving jobs out of school making the most money and they don't have to earn it like the more experienced drivers had to. Then when things go bad because of mistakes they made, whether it's the comapny they chose or accident or late deliveries, they get upset and blame others.
I think there's a lot more to this fella's story than he is letting on. -

I look at some of the posts on this site and wonder exactly who is this site truly for cause other truckers come here seeking advice and as always there is some one on the attack.So many of us deal with so much unfair treatment in this industry,but because we are so divided we wont ever see any kind of change regarding all the mistreatment.Instead of coming together and forming some kind of voice and shine the light on bad companies we would rather find fault in the driver some of us have been in trucking so long they have lost their backbone and would rather keep their head down and take all the crap trucking companies have to dish out all for the sake of what keeping ur DAC clean well driver let me say this no matter what kind of driver u r what kind of attitude u have once its all said and done u r just another number.Then its those same drivers that lure new guys into this already messed up industry with false stories, but as they say misery loves company.So research a company B4 u sign on with them cause trust me if there is 1 complaint there sure to b more,just some of us rather make every situation so simple no big deal we all made the choice to b out there trucking, and as long as we continue to complain to each other nothing will ever b done to improve the conditions out there.So b4 we reply to what another driver posts think about it cause they r just looking for some advice and if u cant say something to help them then keep it to urself.They have been thru enough with their company and trust me its frustrating when u r looking for answers and really dont know where to start to resolve ur issue.

Well.......he did come on and asked questions then layed out his situation, or part of it. And he did get answers and opinions. Weather he or anyone else likes the answers he gets dont really matter, life will go on. Some of the answers could have been toned down some as far as harshness but maybe thats just how they express them selves. Yes we do need to stick together more but we also have to look out for our selves

Fact is trucknmom, That DAC is your life line. Your career. If it gets messed up your done. Game over. You may not like that but it is the way it is. And I for one have worked way to hard on my career to throw it out the window because some driver can't do his job right. I give out the best advice I can and if that means pointing out where the driver went wrong. Well so be it.

Well driver i would like to think we all work hard to build our careers and at the same time that hard work dont mean much to trucking companies in the end.No matter what he came seeking advice on a situation instead of giving him all kinds of usless info some attack him on his job performance when that really wasnt the issue.No matter how many yrs of driving each of us have we all started out as a rookie and even those perfect drivers have made rookie mistakes,but wont ever admit it. The complaints we see on here isnt the 1st time we have heard them in the industry, there is so much we endure and u would think as drivers we wouldnt be so quick to shoot a fella down when he is dealing with anything. Whether he has a case or not we can't say for certain cause people sue for all kinds of things these days. As for throwing away ur career driver dont make to much of it cause all that hard work u did to build it signing with the wrong company can destroy it so save that our careers are just ponds in the game of trucking none of us sign on for the BS we encounter out there.
