i am currently having an issue with the irs about a past 2290,ill try n make this brief,
in 02/2016 i discontinued doing business under my own authority and voluntarily
revoked my numbers and shut down for good and stored my truck starting in 02/2016
until i figured out what the new plan was,by 06/2016 i was a company driver driving quad axle dump
locally until 09/2016 when things got slow and i was no longer needed,hooked up with another
place otr again driving their equipment for the remainder of 2016,then by 01/2017 i was
looking to put my truck back on the road as an Leased O/O,found a place by 02/2017 and
in order to start rolling again i needed a paid 2290 for 2016/2017,since i did not pay it in 07/2016
because my truck wasn't on the road and i was employed as a company driver by 2 different
employers during that time,on 02/20/2017 was when i paid the 2290 to get started again, i
used Express Truck Tax to e-file and then paid the IRS's Pro Rated amount of $229.17 with my debit
card,that's the amount the IRS charged and i paid and everything was fine until 04/2019 when i get a
letter stating i did not pay 2016/2017 2290 on time and they wanted info i didn't have since
i leased on and the company i leased too provided the IRP and IFTA,so i have no proof of past
registration for them for that time period,the vehicle was stored for 1 year and i had sent
back everything to the WIDOT as required in 02/2016,the place i leased to furnished IRP,IFTA
etc. and when i canceled the contract they also required plate,stickers,cab cards etc returned.
they don't understand even after explaining all this to them and proving i was shutdown as
a business and working for someone else and sending all the info i could provide including
a copy of the paid dated e-file 2290 form they are still insisting i did not pay on time and now
are saying i owe $797.50,that is the original $550.00, $137.50 failure to file penalty and
Addition To Tax (accuracy penalty) of $110.00 which is because i couldn't provide registration
proof and cab cards showing GVW so they say it's poor record keeping, they say i was in
business in 2016 cause i filed some income for the company for the 1 month i worked on my own in 2016
but proved i shut down when i said i did. they do have proof that i paid the 2290's prior and after the one in question. i feel i did do everything correctly and i refuse to pay them,any ideas what i can do going forward with this ? suggestions are very much appreciated,Thanks

Are you talking to a live person? In the IRS. It sounds like you are in the right you pay them money, but in the long run it might not be worth the fight. You will lose money sitting.

Did you get the letter from the IRS or the State?
I’ve had a truck put out of commission for a couple of years and didn’t file a 2290 for those years, never had a problem. All the State of TN cares about is showing them a current stamped 2290 when you go to renew the IRP. -
By the way, you always keep old records as part of your good business practices, especially registration things like IRP.stillwurkin Thanks this. -
I think what you needed to do was "suspend" your vehicle since it was no longer on the road for those months in 2016/Jan 2017.
SO you should have filed for a credit for 02/16 through 06/16, and then refiled the suspended vehicle starting 07/16. Then filed for a prorated amount beginning 02/17.
It may be possible to go back and file amended 2290's. Basically you pay in full at the beginning, but if you take the truck off the road before the year is over you get a credit back. That would have covered you for the filing prior to 07/16. For the new filing you would just file the truck as suspened ($0 owed) and then refiled when you put it back on the road on 02/17 and paid the pro-rated amount for 02/17 - 06/17. -

Again TY for trying to help with suggestions,appreciate it,I ended up speaking with two different people in two different departments at the irs about this issue, I explained everything from the beginning to both,one person was setting up a 120 day extension for payment to give me time and he switched me over to a very helpful lady in the 2290 dept n I explained the issue to her,she said I did do everything right n she was going to explain my situation to her supervisor and she would look into it and she must have cause I received a letter with all the previous info and amount I owed,which totaled $1,028.38,and at the bottom of the page it read amount due $0.00 ,that my trucking friends,is a Beautiful thing,Safe Travels Everyone
