OOIDA anticipates precedent-setting win against Supervalu

OOIDA, Joe Rajkovacz and Carl Schaefer Jr. plaintiffs in a class action that accused a grocery retail giant of coercive unloading practices reached a tentative settlement in May with Supervalu Inc.

The settlement, if approved by the court, would permanently enjoin Supervalu from certain practices.

The legal action, filed in 2005 in the U.S. District Court for Minnesota, challenged Supervalus policy of requiring drivers to show proof of insurance coverage grossly over and above what was required by federal statute and regulation. Without that insurance, truckers had no choice but to use the only lumping service available to unload Supervalus cargo; they could not unload it themselves.

Supervalue suck as far as gitn unloaded at them.
Been deliver to them for years.
