I didnt forget. I usually get messages from the mods and admin telling me that while they like my enthusiasm, they need me to tone things down.
He couldnt have killed anyone if he was driving. He gets drunk at a drunk party. He gets into a car driven by another drunk who puts the car in a ditch. The other drunk says "Stay here. I'm going to the store for smokes" and flees the scene.(ROFLOL) This guy sits and waits. 5-0 rolls up and he tells him that he wasnt driving, but he wont take a sobriety test. Gets busted and dusted and loses his license.
Now he comes here looking for help so he can hit the bigroad and be a "bigtime professional driver". Slim left town 3 weeks ago.
Everyone forgive me while I laugh...this is high comedy!

What if you indeed find the second person? If neither one admits to driving, do you charge them both? Or only the owner of the car? I am curious. I can think of an accident around here where the scumbag driver lived, and his passengers died, and he tried to claim the other guy was driving. Not only once, but two separate drunk driving dual fatality accidents. Finally the put the away on the second one.Baack Thanks this.

Not meaning to sound unsimpathetic (even tho I am), but if someone chooses to be a passenger in a car driven by a drunk they got what they deserved.
Do you know the difference between being dumb and being stupid? Stupidity requires intelligence. If you get into a vehicle with an idiot, unless you were kidnapped or taken by force or are a kid, youre stupid. No simpathy for the stupid.

Say a cop rolls up on a single car accident. Two people are there, both drunk. One of them is the owner of the car. Both point fingers at the other. Who should get the DUI? Both. One of them because he deserves it, the other because he's stupid.
Stillwater Thanks this. -
In 1976, my cousin died in a one vehicle accident. There were two people in the car. He was not wearing a seat belt and the car drug him for quite a distance down an embankment.
The second person in the vehicle claimed he was not the driver, but evidence was not conclusive. My cousin was drug down the passenger side of the vehicle. He told the investigating officers that my cousin was the driver. He left the scene and was not found for about 2 hours. My cousin may have lived if the accident had been properly notified to authorities, and not a couple of hours later.
No one was charged, but later among my friends, we heard that he was bragging that he walked away and had been driving.
As far as who gets charged, I let the police make the decision.Stillwater Thanks this. -
Right, both should get it, but what does the law say?Stillwater Thanks this.

The law says the person with the deeper pockets will walk clean.

Personally, I think the current setup is a waste of money. Why do all the DUI stuff and have checkpoints and whatnot and give tickets for something that could have happened?
Someone goes to a bar and gets liquored up and drives him, the cops shouldnt be allowed to bother him unless he damages property. If he kills someone not riding with him, they should hold him right there, call a magistrate and the victim's kin out and have a roadside execution, performed by the next of kin, witnessed by the magistrate. If the next of kin doesnt have the stomach for it, have the cops do it and bill his family.
No slick DUI lawyers. No appeals. No crowded jails. No repeat offenders. No last meal. Instant justice. Safer roads.
The only reason they write DUI tickets is for revenue, not safety. Got deep pockets, they slap you on the wrist and you can do it all over again.Click to expand...
