Werner did the same to myself and my team-mate. The company even had the audacity to complain when we tried to do a rotational reset. This is where the truck keeps rolling while one team member is on restart, then the other. Even without such, we were pulling the same number of hours for the loads assigned. ie 5 here, 8 there, before the other could log in as on duty.
Did you have the same OER qualcomm issues we had? Logged as on duty while in sleeper ect? That, and a few other situations were a constant nonstop issue the entire 7 months of our employment until Werner fired us in 12/2008, for mistakes and criminal behavior of the company's own safety office personell.
Good thing my team-mate dialed 911 before notifying Werner when our truck started itself up, and left the fuel lane by itself, under the drivership of Charlotte Towing in Charlotte NC.Had we not, the truck and load would never have been recovered...on Werner property, by cdpd and charlotte towing. The same company that "Recovered" without a towtruck, the Truck Werner in NE "claimed" was the truck that was to have been recovered to begin with, before Werner changed it's story to the police. hmmm 2008mBlack Kenworth bobtail, in back lot....blue on blue 2005 Freightliner under live load in fuel isle...yep, that's the right truck alright. Drivers stole it alright, selling off the still sealed on trailer load alright....

On a side note, if a company is going to mismanage a teams time so badly, irregardless of the miles that team can pull under legal 10 on, 10 off rotational hours, the dispatcher/safety/planner/owner cannot legally complain when the solo or team pulls a 34 restart, irregardless of how that restart is pulled.

We use the 34 hr reset. Our company has no problem with it and have in fact encouraged it.

day 2, 10
day 3, 8
day 4, 11
day 5, 12
day 6, 7
day 7, 9
day 8, 10
now day one which is where you started, thats the hours that fall off at midnight that gives you 9 hours to work tommorrow, now if day one had 0 hours instead of 9 then yes a 34 hour restart is mandatory hope that makes it easier. -
Thanks for trying but that makes no sense to me.
Aside from the fact that in your example you would have been in violation of the 70/8 after the fourth hour on the eighth day what you say suggests that if you ever have a day with 0 hours then 8 days later you must do a 34 hour reset regardless of how many hours you have worked in the last 7. Therefore, if you ever have a 0 day you will never be able to work more than 7 in a row and everybody started at some point so everybody started with a 0 day prior to their first day. Not trying to be argumentative or anal or anything but that just makes no sense and there is nothing in the regs to back it up. Considering the fact that a recap is not required, if what you say is true, it would be clearly spelled out that a driver is required to take a 34 hour reset after a maximum of 7 days of work. -

The previous post is correct in his total on this example...however on day 8, just wait until 8-9 pm and begin your days driving..at midnight you catch the 9 coming back into the loop from day 1...drive three more hours..take a ten hour break..which means you have driven 6 or 7 hours, take a ten, then wait until 6-7 pm to start driving again. On an on and on..it just never ends!
It pays to only drive 8.5-8.75 each day---you will never run out of hours, plus you will have a few hours in reserve if you need to plug a ten hour day somewhere...that is part of "on-going planning", this business is never static, always changing--plan as well as you can but expect the unexpected, and don't expect thing to run smooth..there is always a wrench waiting for the monkey to make it work(just twisted up the old line there).
The 34 restart is never mandatory...always optional! -
We've never had a problem with a restart from the DOT although a company we used to work for who shall remain nameless (blue trucks, begins with W and ends with er) got really po'd at my husband and I when we told them we wanted to do a 34 hr restart. Between the 2 of us we had about 2 hrs left on our 70, he was gaining 1.5 at midnight and I was gaining a big fat zero. It wasn't our fault that our first load out of hometime was BS. Anyway, we were in Seattle and they wanted us to go to Portland to pick up a load. We told them we were out of hours and if we managed to get to Portland and pick the load up we couldn't take it anywhere till midnight and then could only go 70 or 80 miles with it before we would have to stop again and wait for midinight. They tried to tell us that they would get us a swap once we picked it up and we said what good would that do, we'd just have someone else's load that we couldn't roll with. They then told us to call the log department (I think they thought that the log department would be able to "fix" the electronic logs). The log department said "Yep, you're out of hours, I suggest you sit tight and get a 34 hr restart.' We sent a message to dispatch telling them what the log department said and they sent a message back saying "the log department isn't your boss, it's up to us whether you roll or not." To which we politely suggested that maybe we should call the DOT and ask them if we have any hours left. To which dispatch said "take the break and call your fleet supervisor first thing Mon. morning." Our fleet supervisor, who actually had half a brain, told us on Monday that we did the right thing. If we had picked up the load we would have ended up in trouble for causing a late delivery. Go figure.

So therefore it is my opinion that you do not have to log a stop that is less than 15 minutes. -
This is what our logging instructor taught us. I'll have to ask again for clarification.
