So, what happens when they request the passenger permission slip from the company and there is not one?

 

I have had the same experience, however I never log in on SB, I'm always off duty for 10 continuous hours. This means you can be in the front seat, I've had my logs looked at numerous times and all inspectors are ok with this. However, I will only be in that seat, either during the first 2 hrs or the last 2 hrs during my 10 hr period. Less confusion in the matter, my logs go to the company as well and this doesn't bother them at all. My 1st seat has taught me this and he's been doing it for a few yrs, his logs has been looked at, way more than me and he's never had a problem either. I just cannot sleep for 10 hrs, but I can for 7-8 hrs, so this works well. Off duty means it can be both...

Maybe someone in here will disagree with this, but I'm telling you, we've never had a problem with cops or DOT.....

 

Technically, sitting in the front seat when entereing a scale or pulled over, you can be found to be on duty not driving. It is the driver compartment. It is what dictates it.

I can certainly see how foolish it is, because sitting in the back is a drag. At least you can sit there and be entertained and watch the world go by.

 

Or what happens when they check your log and you went into the sleeper in CA and came out and did a pretrip in AZ ? Like to see you explain that one to a DOT .

 

Nothing prevents the officer from reviewing both sets of logs. If the first driver is placed OOS the second driver would have to take over.

By reviewing both sets of logs the officer is able to verify the accuracy of the other set.

It's been a while since I drove or worked the scale in Cortez, CO; however, I have a hard time beliving the driver was issued a $400 ticket for a log violation.

In 1993 I was placed OOS at Limon, CO and written up for a 10/70 hour rule violation. Penalty? $39.00

I worked the scale at Cortez, CO from 1997 - 1999 I cannot ever recall writing a citation for a logbook over $75.00.

Be careful about spreading urban myths. They cause undue stress.

It's not an urban myth I walked up when him and the transportation manager were talking about it. I asked him what happened and he told me. He showed me the ticket it was $400 for falsifying logbook. It was not at the scale anyway. They were driving down the road a bear was setting there watching traffic and watched his wife walk out of the sleeper and sit down in the jumpseat then pulled them over.

 

Can you be on line 1 in the passenger seat, assuming the truck has no sleeper?

 

Nope, in a daycab you would be the co-driver, line one is reserved for off duty AWAY FROM THE VEHICLE.

 

Taking your logs into the sleeper won't work. It will only get you woke up, to hand them through the curtian.

Having your CDL in your wallet/purse can have the same result. An officer can ask to see your credentials....regardless. Most won't though, as a matter of courtesy.

You will eventually...and when you do, so will your company. Good luck with that.

I hope the company has really deep pockets. They'll be charged per violation.
