JJ - does your truck have the word "Mistress" painted on the back. I saw a red truck with "Mistress" on the back of the cab in Henderson - not sure if was centrals terminal or someone else's - flew by too quickly. Regardless, it made me think of you.

Jolly came on here to read the helpful answers that many gave to my questions, when he ran across your answers to me. I pretty much overlook discourteous behavior because not everyone knows how to say what they feel or think in a polite way when they disagree. OK, I think there was a little mis communication here. the comment that started all of this came from steelers fan not brickman. further more brick was agreeing with you about leaving central not trying to taunt you all. keep in mind these are words typed and you can not make an accurate assessment of ones feelings unless the person expressed it to you in person. computers cannot accuratly express your emotions.

The Federal Motor Carrier Safety Regulations, 49 C.F.R. § 390.5, absolutely eliminates the distinction between independent contractors and employees so that any attempt by a carrier to label a driver as one or the other is an exercise in futility. Drivers, including independent contractors, are now legislatively deemed statutory employees of motor carriers and, as such, motor carriers can no longer escape liability through the use of linguistic gymnastics. The carriers fate is now inextricably intertwined with that of its driver. In Shell v. Navajo Freight Lines, 693 P.2d 382 (Colo. Ct. App. 1984), the Colorado Court of Appeals noted that [t]he regulations, which have the force and effect of law, eliminate the defense of independent contractor by making the owner/operator of the equipment the "statutory employee" of the carrier.

There was a case not long ago involving prime with the IRS on this matter involving the independant contractor status.

From what I read on Jolly's lease, there is nothing that even comes close to suggesting he has to have someone take over the lease. The only thing in his that says anything about getting out of hte lease is that he has to give a written notice on or before Nov 1. That is why I took the lease to the lawyer to see if I missed anything. He recently leased, so maybe the new leases aren't including that... there is always fine print with "lingistic gymnastics" ... and since I'm not a lawyer, thought I'd let one tell me what the lease actually does say concerning geting out of it.

It is also better in a way to try and have the lease taken over by another party so that you can leave on good terms with nothing reflecting on the USIS and recieve the performance bond back. but if not just give them 2 weeks notice and get back to the terminal you got the truck from and take photos, clean the truck up and have the Mech check the truck in and sign that everything is in order and make sure you have a copy. the only thing they could possibly put on the USIS is didn't finish the lease agreement and nothing else. then you throw in all the evidence that you have including the the lack of load info as the reason you terminated your contract and the USIS will add that to the dispute in the report or remove the carriers comment al together.JJRanch.

Your probably right jj but it would seem to me that that would be more of a favor to the company to find someone to take it over and i would do that if there were other reasons form me wanting to leave. but after practically begging for loads and now being in the hole because of it, and central not seeming to care, im not one for favors when im not getting the benefit of decent work to begin with lol

Well 1bad is still in WVC waiting on a new truck! He said about 20 new prostars rolled in this morning. Hopefully he will get rolling soon. The Kraft dude is eager to get him back out the east coast and on his route. He is lost since JJ and Larry left yesterday and bored out of his mind. if he's bored, he only has himself to blame. he's more then welcomed to call. i know what it's like sitting around 1500 miles from home. i'd be more then happy to take him somewhere. you all extend your hospitality when your central brothers are in the neighborhood. the offer works in utah too. i may not be a central brother, but i AM a trucker brother. if central would take experience i'd be on board in a second. but as life goes, i'm forced to look elsewhere.

I did remind him of your offer again today. However with everything that went down today I don't think you or anyone else would want to be around him. He with out a doubt is not in a happy meet and greet place tonight! right now I am in chill him out mode. Lord knows we can't live with no income at all coming in. Hopefully he will get to talk to JJ tonight and get some brotherly advice on who to talk to there tomorrow to turn this nightmare around!
