    Well, don't think it's just the trucking industry... I moved to Cali (my partner's family is here) to be near family and the pay was really really good. Then the economy went south, and I got RIF'd. I thought I was going to go crazy...no way could we live off of one income... two kids, dogs, a house...then I got a job...and then our governator did another budget cut, and I was informed I might be rif'd again. They managed to rearrage some of the teachers and I got reassigned to another school. Then I get notified that if our governator makes another cut, I won't have a job come this August. I am sure that is adding to Jolly's stress, that both of us are in danger of financial destitute. I can totally symapthise with Newtruckerwidow. IT's one thing to be in financial trouble when it is you alone, but when you have a family, it becomes a nightmare. My prayers are with you Newtruckerwidow, and to anyone else who is in this same situation. I take a breather and sigh remembering the words I often heard my mom say, "This too shall pass."

    So if I understand these post about leasing correctly, if they offer something to a company driver they have to offer it to the L/O - like insurance, health benefits, 401K, etc??

    Performance Contracts - What trucking company is going to offer that? I agree with the concept, but currently, it is much more profitable to fight this thing in court, take your losses on fees, court cost and fines. I am not sure, but I think that this could become a Class Action if there were enough L/O's to go after all the companies with any type of size to them.

    Independent Contractors - One of the big deals with the IRS on this subject is that an Independent Contractor must truly be independent - meaning that the entity doing the hiring of the independent contractor cannot dictate how the job is done. I had an appraisal business, I was required to post available jobs, I could not assign those jobs to individual appraisers. I could only say that the appraiser that takes a job from the job postings, must be a State Licensed Appraiser.

    If I had a hot appraisal, I could only assign that appraisal to an employee or do it myself. If no one picked up an appraisal on the postings with in a day, I normally did those appraisals myself. If the appraiser had a question, technically, I was not allowed to provide guidance or advise; if I did, it might be considered as breaking the independent contractor status.

    One appraisal firm that I know of here in Colorado had to pay out 125K in back taxes and benefits because of how they handled the Independent Contractor issue. And appraisal firms are peanuts compared to even a small trucking company. Think about one that has 1,200 trucks or more.

    The way I see it, if Central tells you what to do in any shape or form, you are an employee. On another thread, the company was telling an L/O when to stop driving and when to start, this definitely makes them an employee.

    Do you guys that lease get the depreciation? I would assume not. Do you get to write off your lease as a cost of business? I would assume you do. If not it has something to do with the third party lease thing. But I bet you could get away with it - maybe not - ask a good CPA!

    Y'all know what happens when one assumes.

    And this is where the IRS wants there money - there is a double dipping of sorts here and it is not in the IRS's favor. That is why they are very tight on the Independent Contractor status.

    I'm going to take you word for it & hope you know what your talking about because other them my joke about Modesto I have no idea what I said that would have been offencive (Offencive to me at least).


    Trust me I feel for all of you with the money problems we all seem to be facing. I might not talk about it as much as some, but I'm not doing very well with keeping all my bills paid.

    I also know that I'm not in nearly as bad a shape as others, so don't take it like I'm looking for sympathy. All I have is my GF & myself, I have no idea how you guys with family's do it.

    Brickman...here's my truce. I am not a combative person, and I agree with JJ that you can't read emotions through text (I felt like I got "told" by dad...lol) ... I will tell you what got to me...and I did check to make sure it was you because when JJ said he couldn't find anything, I felt horribly stupid...and ashamed to have reacted without cause... so I went back to check where I got confused, and I found it. You highlighted my quote and then responded, "opinions are one thing, but lies are another"....page 360. I will leave it at that you maybe meant it a different way or didn't finish what you really meant to say, and go on with the spirit this forum was intended to used.

    So no hard feelings on my part. :love4:
