AB5 coming to NJ, thoughts?

    I agree. This will either force drivers to full blown company or full blown O/O. It will kill 1099 companies

    I’m sure the states think they’ll have a bunch of money coming in from employment taxes. But the reality is many will just get their own authority and continue to file their taxes as they do now. The insurance companies will be seeing the bulk of the cash influx because they’ll be getting that big money from a “new carrier”.

    Will this crsp apply to out of state carriers, too?

    For example, I'm a PA based independent leased on with an OH based carrier. Will I still be able to operate in CA or NJ?

    Not that I do, hate both states. Just asking out of idle curiosity.

    Good news for me! Just bought the truck, not interested in losing everything just cause the states feel they need more money to waste on stupid stuff.

    The proposed legislation will not survive in it's present form after a trip through the court system.

    What happens to all those US Mail contractors that drive their straight trucks from one little town to another? Does the USPS now have to do it themselves? Buy trucks? Hire drivers? What about FedEx Ground and package drivers? I just don't see how this will hold up in Cali or NJ, which by the way those 2 states are made for each other and if either fell off it would not be missed.

    Contractors will get paid the same as employees. That’s if a contract exists. Technically there still would be O/O’s under these circumstances: Driver is not leased to a carrier’s board, driver is not leasing their equipment to a shipper/carrier, shipper/carrier is not leasing an truck or trailer to a driver.

    The board or load lease is a gray area. I think you would be considered as an employee if you have a contract that says driver has access to a certain load board and carrier/shippers take a small cut in return.

    So to get paid as an o/o with this law. A shipper/carrier/broker will need to conduct a transaction with a driver. Driver takes something from point a to point b, then driver gets paid. End of story.

    it’s a beg mess. Everyone will get affected.

    First trucking company they visited, they left any owner operator alone if they were a type 'S' corporation and only went after individual owner operators and LLC's....

    Type S has their own workmen's comp and is taxed so they can't say they are miss-classified to avoid paying comp and payroll taxes...

    If NJ fell into the sea and the seas rose 20 feet; I'd have beachfront property.....

    More so than the trucks that are leased onto a carrier, they should go after those temporary driver companies that pay all the drivers on a 1099.

    There are quite a few of them in New Jersey and they state that the driver is an independent contractor so they don't have to pay any taxes, lazy slobs.

    I hope they shut every one of them down.
