Independent Contractor and Insurance

    I've been doing CDL A jobs as an independent contractor.

    I work in the audio production world. The company will rent a truck. They have insurance to cover the truck.

    My question is: What other insurance should I carry? I don't currently have any other insurance and I think I've been driving "exposed" as they say in the insurance business.

    Note: "independent contractor" doesn't mean owner operator in this context. It means "non-employee" or 1099-form. Hopefully, that makes sense.

    Independant? And the company rents a truck?

    Erm... You need a lawyer to see if you are really exposed or not.

    I carry a million plus in insurance on me personally against Judgements. If I smashed up or hurt enough people for them to need millions in lifetime medical care they can stick a fork in me. I would be done.

    do you do anything else for the company?
    do you choose where you go or do they ?

    sounds to me like you a defacto company employee and they are trying to skirt the law.

    you are a defacto company employee.
    they are trying to get away paying no taxes and benefits, as well as getting around overtime pay...

    so basically you should quit and find a real company to work for that puts you on the taxes. Sends you a W-2, not a 1099 and gives you benefits. Rather than be taken advantage of.

    anytime. you need to decide if you are ok with that. Most likely they arent going to change.
    IF you are involved in a accident, they will try to not pay, and will push their insurance not to as well.
    you will have to sue the insurance company and possibly the company. Been there myself.
    The biggest factors in whether or not you should LEGALLY be w2 or 1099 is who owns the equipment, and who decides where and when the driver goes.

    That pretty much settles that then. Get out of that outfit.

    OR simply refuse to drive the truck. Because you are being mule'ed and its not nice.

    Ive been around the block a time or two. But these companies and their suits are GETTING VERY SMART an worse ... SNEAKY about keeping costs down. While Employee Doolie knows nothing.

    Not acceptable.

    In fact.... whistleblower comes to mind. These stand to earn 10% of whatever Uncle Sam Recovers against Sneaky Company.

    1099 is how i get paid
    i own the truck and trailer
    i book my own loads.
    you should either be compensated with mileage, salary, or % of revenue
