OK, I'm driving a day cab and due to the impending blizzard am forced to stop because I do not have the hours to get back to my terminal. Would I be able to sleep in my day cab and take a 10 hr break?

NO There is an exception in the HOS rules that allow going over hrs. in case of inclement weather
-
Kind of hard to log sleeper in a day cab....
I would like to see you stammering out an excuse to DOT on that one...
future driver Thanks this. -
Uh, doesn't the allowance only state that he must be within a couple hours of home terminal? Otherwise he must take the break?
-
The allowance is 2 additional hours of driving.
Dominick253 and misterG Thank this. -
Having driven in NASTY weather as we all have, it could take him two hours to go one mile.
Course, if that was the case I would be questioning why they were on the road to begin with, unless the delay was due to breakdown's\accidents.Dominick253 Thanks this. -
update-just called to say I was not going to make it due to the weather in VA. DM called me back and said everyone has to attempt it. I will travel I95 from PA to VA. Wish me luck.

I would tell him he needs to attempt to understand the HOS and get me a motel on their dime.Dominick253 Thanks this.

you are driving right into the storm you cant take your 10 in a daycab you must go to a motel and they should pay
Dominick253 Thanks this. -
Sitting in a day cab for any amount of time while parked is line 4, techinacilly speaking, however, since you are allowed to do anything while off duty, I would log line 1, but, certainly not line 2. Make sense?
halfburn Thanks this.
