Hi folks new here and glad to have found you's!!
My first question here is about the 10 hour rule for rest time. My company I drive for is a short haul so I'm home everyday. In the last past few months many of our drivers, me included, have been getting up to 4 calls at home on home phone or cell and waking drivers up each and everytime. I don't like to turn off my phones just incase I have to go to my daughters school incase of a issue and they can't get ahold of my ex-wife.
I should say my drive time is at night and I sleep during the day.
I was woke again today after being in bed for 3 hours. I have a tough time going back to sleep after such a thing.
My question is this, is there a written guidance in the regulations in US or Canadian print that companies must leave drivers to rest so driver has proper rest to beat fatigue? Maybe a law?
Any direction to help would be good and thank you.

I don't think so, I just don't have a phone near me if I want people to leave me alone. I've lived in apartments where the next door neighbors are loud and party all night keeping me awake, and DOT says it's our problem to figure out how to get proper rest.

Thanks Mark83, we had a safety guy who was new and was cracking down on this and was getting it under control, but he has left the company. Now dispatch and such are going back to their bad ways!!

The office works during the day. That's when they are going to conduct their business.
You might talk to them and ask that they refrain from calling during the day...limit their calls to before a certain time before you would be climbing into bed or after a specified time closer to when your alarm would be going off anyway.
If that doesn't work, add a line to your cell phone plan for $10/month to use as an "emergency contact" phone. Only give that number out to family, friends, kid's school, etc. that you don't mind being awakened by. Keep that phone on near the bed where you can hear it if it rings, and then turn the ringer on the other phone off and keep it in the other room.
I guess it all depends upon how respectful of your rest periods your company is willing to be, and to what extent you are willing to go in order to be able to sleep through the nigh....errr....day.

Guidance from FMCSA follows:
Meltom Thanks this. -
First, assign a ringtone to dispatch. If you want to sleep thru the call make a quite one. but, just because the FMCSA says its legal does not mean you can not consider it as on duty time. restart your 10 hour break a few times from the point of their call and they will get the point. Contrary to popular belief a drivers HOS belong to the driver!

1. Change your home phone number.
2. Make sure the phone company does not provide the new number to those who dial the old number.
3. Make sure your daughter's school and any other agencies associated with her have the new number.
4. Tell you company that you no longer have a home phone, only a cell.
5. Turn your cell off when you go to sleep.

My wife set up my phone so it only accepts calls or texts from certain numbers during certain hours. Your phone may have the same capability

Hi drivers! All good points everyone has made here. Thank you!!
I have addressed this several times with the office staff and it corrects itself for a bit then right back to old habits! Old habits are hard to change. I have said to them there is no reason to call me 3-4 times in my break to tell me you have changed a load destination or start time till at least around the 9th hour off. At the 3rd or 6th hour off calling me makes no differenence as I HAVE to stay off 10, so why not wait? We are computer logged and it is easy to see when I logged off for the start of 10 and easy to count when my 10 is nearing up!!
Just seems so simple to be professional and considerate!
Again a big thank you to all!!

A dedicated work line, pre paid or a second line on the cell account.
Give the new number only to people other than work as they will try the old number when you don't answer the new one.
When sleeping or off just silence the number work has and hope everyone else knows not to call. Voice mail will tell you what you need to know after a nap
KentuckyBound Thanks this.
