1099s force drivers to violate HOS.

    I watched a YT blog for a brand-new driver on his first solo run for a major company in the Southeast. His initial load required him to be ready for dispatch by 7 a.m., but he wasn’t dispatched until 10 a.m. He reached the receiver at noon and didn’t leave until 4 p.m. He illegally used personal conveyance to make it to his first delivery after swapping out his original load, which he couldn’t deliver on time. He also failed to account for heavy traffic on his final delivery and ended up being an hour late. Walmart rejected the load, and he had to sit on it for a day until a new appointment was scheduled.
    He spent over 3 days on a 441-mile load with 2 stops made around $300 violated HOS and a service failure. Anyone want to bet how long he lasts?

    I been doing this for nearly 10 years... no one is tampering with my logs. It comes down to good dispatching, keeping the left door shut, and knowing the regulations and how to use exemptions legally to my advantage.

    Just a few weeks ago I ran 7800 miles in 13 Consecutive days. Yes its possible... easy no, exhausting yes. But my choice.

    Don't believe it that's fine, to each thier own. But I can assure you it is possible when you are running frombthe rockies to the mid west and back every week and know where all the little hidey hole parking places are to be able to run your 11 down to 10 mins or les most days. 4300 miles in 70 hours is 61.41 mph, take into account that my east bound load qualifies as Ag Exempt. Under 395.1 (k) giving me a few LEGAL free hours each run... it's very doable.

    I run 3600+ every single week, and I have a slow truck.

    we run a lot of ag exempt also and some days I can run all day and never have to get off the top line.

    The key in my opinion is know how to act like you are the owner of your business and financial future. Some of us who understand 1099 as a business owner (which getting paid that way makes you one ) who sets when and how you choose to work; who understands the tax implications and plans for it; and understands that you as the independent are in charge and can dictate the terms or reject the terms can be very very successful. But if you accept a 1099 but treat it as though you're a W2 employee who has to be told what to do, when to do it, and how to do it..... You're going to fail and or get screwed..... But I personally believe that's on you for not understanding how to protect your career and financial future. I have run my own businesses and worked as an independent paid on 1099 and usually prefer it. As far as HOS, as others have mentioned if you understand the rules, and how to do so safely (yes telling your dispatcher it's not possible or that the load will be delayed because you need rest) you absolutely can run far more hours and miles (and make more money). Those of us running Agriculture and livestock know how to run the long days safely. My dispatcher runs just as long as I do, and also doesn't micro-manage my time management or question when I decide it's nap time. And I'm a W2 company driver. I know how to communicate with him the possible adjustments that will be needed for loads and pickup or delivery times based on where, when, weather, traffic, and how much rest I've gotten. Here again, it's up to the driver to be safe, communicate, and understand the rules, exemptions and that they're ultimately responsible for the safe operation of their vehicle. There's so many variables in the industry and between load types and locations that "one size" will never fit all. Likes been mentioned these "bad apples" paying 1099 can and will because the drivers let them and don't understand what being an "independent" actually means . But there are great companies and opportunities for "independents" who do actually understand what it means and treat it the right way and walk when the "terms" don't fit or aren't met.

    If you let these scumbags tamper with your logs, well, ok. You will be the one hoping Mr. Hammer and Sir Butt Reamer uses a quality class of lube. You will the one paying for these ######## making profits of your idiocy.

    Well it's easy, your the one making the decision on where you work, just say no say move on. I realize that todays drivers do not want to take responsibility for there actions, does change anything though, you decide what is exceptible.
    For instance a couple of weeks ago I told Heartland I need a family emergency leave, they said no, did not change anything as to what I needed. Delivered my load to Home Depot Phx, tool there truck to the yard, called a UBER to take me to Skyharbor, and here I am home to take care of my personal business. They (meaning the company) cannot control what I am going to do. Does it affect my future, probably so. There are many acceptable companies t drive for.
    I may go to Arc/Bst Reno, they need drivers no there Petsmart account.
    Like I always say, I always have a choice, even at 70 years old, just now I drive because I want and enjoy driving.

    FYI 1099 aren't the only ones. I've seen American owned W2 500+ truck companies 'fixing' logs in recent years.. I could name some that even have 1-2 year experience requirements..
