16 hour short haul exemption

    It is not factually wrong, it is only half wrong. Although you are correct, he still has to take his 10 hrs. seeing as how he worked over 14 hrs.

    1. State he has to take a 10 'after' the big day?
    2. State the big day is only for OTR truckers?

    I apologize, I may have read the rule wrong, but, the local driver exemption does not allow for a split sleeper berth time. To take advantage of the split sleeper rule you have to do logs sheets as if you're an OTR driver. So, if you're logging as an OTR driver you can't take advantage of the 16 hr rule. Even if it was a possibility, he'd still have to take that 2hr off duty break at his original starting location. Then work some more then, come back and take the rest of his break. And, all of that would have to be logged. If he's running local and within 150 mile radius, he doesn't even have to log. The law includes a lot more than the snippet of an exemption that you included here and no where does it allow for a local driver, under local driver rules, to take a sleeper berth split. Hence, he'd still have to take 10 hrs off after a 16hr day. If the law doesn't account for it neither will the DOT. Sorry it took so long to reply,phone #### out on me.

    Why not? The local exemption is still logging and follows all hos rules. It simply allows for a timecard vs. a full graph log.

    Where in the regs does it state that?

    Then show the regs that back up your claim. I'll make it easy and link you to them.

    I'm done with it. I made my point. I've worked 20 years as a driver and 15 local and every single person I have dealt with interprets the rule this way. If you don't that's fine, but , you're probably not as right as the DOT officers who ran our audits and passed out fines. I actually don't give a #### what you think, I was just trying to enlighten you.

    Really trying to enlighten? Then please enlighten by giving the regs you keep stating exist.

    No, you simply are one of those people that have formed an opinion and no matter how that it's not based on any facts, refuse to believe you are wrong.

    Unless, of course, you can actually show the regs.
