    There is attempted Murder, I wonder if they can do Attempted vehicular manslaughter? I don't know. Never heard of it honestly but I wonder to:yes2557:

    Just because the guy fell asleep doesn't mean his logbook was illegal. There's never going to be a law written that will ensure a person has adequate rest. I can spend 12 hrs in the sleeper and never actually sleep, but be more than legal to drive. That's when one's judgment of one's own abilities and limitations should over rule any federal regulations. What I mean is, just because my logbook is legal that doesn't mean I'm well rested and I shouldn't drive or be pressured to drive just because I have hours available.

    In many states, an "attempt to commit a crime," is a crime. However, there are crime of intent, which is what this is written for.

    Manslaughter, is not a crime of intent. It is sort of a catch-all for when you accidentally kill someone, when you had no intention of hurting anyone.

    Of course, if you are committing a crime, and someone is killed, even though you did not have the intent to kill anyone, you will likely be charged with murder. This is called "transferred intent." And often may lead to a plea bargain of manslaughter, along with whatever other crime you are charged with. But it would probably not be charged as manslaughter initially, because it doesn't give the lawyers any room for "negotiation."

    So it is highly doubtful that there would be an "attempted manslaughter" charge filed. I don't believe that would codified as a crime.

    Oh, the vehicular manslaughter really makes no difference in what I just posted. It only means that the person was killed in connection with a vehicle, in some way.
