2 beers, on day off, in personal car = fired

    The rest of the story? Well he did try to explain to cop that he was not back to work till Monday, seems pretty typical as soon as you say anything to a LEO you suddenly are arguing that they are wrong. Aside from that there was nothing more to the story. The employer knew he was off work, he was fired for the conviction itself.

    My question was about the conviction. Isn't the fact that you are off-duty important???

    And I do NOT agree Saienga driving under the influence is NOT driving under the influence. It is not that simple. I could have consumed double the beer he consumed and not be charged. He was guilty because he HAD a CDL, not because he was drunk. I clearly stated he only had 2 beers and that at least an hour before driving and before he even ate the dinner.

    Big Don they did tell him that the firing was insurance related, the initial 60 day suspension pending company investigation was their own policy.

    Short turn signal, not signaling xx feet before executing turn. Like I said was gonna let him till the last second.

    But his royal majesty did in fact say in the courtroom "as a holder of a CDL you have no business drinking in a bar or at home. You professionals are expected to hold yourselves to a higher standard than your neighbors."

    2 beers. I can blow higher than 0.05 with flippin' cough syrup! That's using as directed. LOL

    Well if he was convicted,

    then he automatically lost his license for 1 year.......

    He HAD to have had a lawyer and got it reversed then cause I know it has not been a year yet and I know he is back to work with the same company driving.

    So you can drink on your day off? When you are not working the BAC is that of a normal license?

    .05 is not a DUI. There's more to the story we are missing.

    The .04 thing applies to while driving a CMV. In your personal vehicle it's .08. A CDL doesn't matter.

    Did he go to a redneck court defending himself? He needs an appeal with an attorney. Then I would sue for damages for the injustice.

    Truth be known, he blew a .12 with the old two beer excuse. Some can't even accept being wrong even when convicted. Everyone in prison is innocent.

    I find it hard to believe he was convicted under what you say. Something ain't right.

    I am guessing that the cop wrote him up in error and said it was a cdl thinking it was cmv.
