Seriously the Infamous "2 beers", If that is the real answer- you should just go ahead and lie to to police because he is going to assume you are.

    Old thread. :)

When I worked as a paramedic, cops would hop in the back of the ambulance to interview victims of crashes while I was treating them. One cop asked a guy how much he had to drink. As usual, guy said "2 beers". Without missing a beat, the cop looked at him and asked "well, were they 40's?" :p

In CA, the limit for a cdl-holder while driving a cmv is .04. The kicker is that 99% of pickup trucks are considered commercial vehicles in CA, so you could get a DUI for a .04 in your personal pickup while off duty.

I know this is an old thread, but I just found this on an attorney's website for Ohio:
[h=3]Columbus Ohio CDL DUI Defense Lawyer[/h]A commercial driver faces serious consequences if arrested for DUI. The limit on blood alcohol concentration (BAC) is much lower than other drivers. Where a regular driver is allowed up to .08 BAC, a commercial driver cannot register above .04%. If a discernable amount of alcohol (any amount) or drugs is found in your system, you will be taken off the road for 24 hours. However, the laws have become even more stringent, starting in 2005. Now any person who has a CDL can be arrested and charged with DUI even if not operating a commercial vehicle. This means that you can be driving your own personal vehicle, not at work, and you will be arrested and your CDL will be suspended.

    This is true.

    HOWEVER.

A CDL driver in a personal car is NOT A COMMERCIAL DRIVER.

Does not matter to me, 2 beers is enough for you to be impaired, away you go. Drink and drive shoould equal throw away the key. We do not need drunks driving anything. You may feel different when oone kills your wife or child. Hook them up haul them away.
