    As much as I want this thread to slip into obscurity and just disappear simply due to what I felt were misunderstandings because of my lack of clarity, I feel obliged to agree Big Don and I am sure you are right. I certainly did get on the 'what if' scenario of the story I was told being right. Sorry about that.
    This I totally agree with.
    Thanks everyone, especially those that brought in the law and code.

    sorry to tell you it is true, i live in TN and like alot of states if you have a CDL it's .04 no matter what you are driving.... just like if you have a CDL you can't go to traffic school to get a ticket off when driving you POV....

    like it or not we (CDL HOLDERS) are held to a highter standard

    I just looked at the TN rules and it is the same as most states.

    It references cdl only in the fact that they are driving commercially.

    I stand by the facts, that there is no distinction between a personal dui rate and a cdl driver driving their personal vehicle.

    If you wish to post the law to support it, then feel free.

    I know many people with cdl's that are not active and they are treated as personal licenses.

    I'm sure we all know that the law is crooked in everyway. When a cop gets pulled over by another cop for DUI or DWI,(regardless if in his cruiser on his personal car) they will have a story on your local news channel about it(if so), BUT he/she will NOT lose their license for it. They are suppose to uphold the law!! All they get is a slap on the wrist while we get pepper spray and a choke hold. Cops will be cops. He shouldve took it to trail by jury. 2 beers ain't sh**. Having a CDL and driving your own personal car AINT a "commercial vehicle". Those 2 don't go together and SHOULD NOT! You should not be more responsible as if you were driving your truck(to were you can only have half %BAC) then regular drivers WHEN you are OFF DUTY?! I hate the law

    CSA2010 says any measurable amount of alcohol is a NO NO. Blow a .001 and you could get a ticket. We drive under the fed's law, not the states.

    Especially since the csa2010 only deals with the driver while in a COMMERCIAL VEHICLE.

    Not your personal car.

    I live in the Buckeye. I just took the Hazmat endorsement test 3 days ago and in the cdl booklet it says cdl license holders are subject to stricter BAC %, whether driving a cmv or pov, a cdl holder, the BAC for a cdl holder is half the legal limit.

    I checked a website of an attorney I know personally, Greg Mathews, he is a former state prosecutor prosecutor, his website confirms .04 is the legal limit for cdl holders in ohio, driving pov or cmv. ORC 4506.15 (A)(2) shows the penalties for first offense, etc.

    I further contacted a common pleas judge in Richland County {mansfield}, Ohio that I know,
    he verified and confirmed the ORC statute and stated that the bac for cdl holders in ohio is half the legal limit.

    Sir I encourage you to check the Ohio revised code, you will see that at least in ohio, a cdl holder is allowed half the legal bac for the state, whether in pov or cmv.

    I cannot speak for any other state......GO BUX!
