But you have opened a can of worms here.
If the OP is just a driver, who is driving a truck owned by the individual, he is an employee. Not a contractor.
You cannot be a contractor if you are just driving a truck.
So, it kind of makes the issue moot.

But it happens ...
See the lawsuit against Fed Ex about wrongly classifying workers / drivers as contractors -
After all, they require them to wear uniforms. -

I have driven for several places as a 1099 contractor.Never was charged for any Workers Comp insurance.
Something does not sound right about that deal. -
