IIRC, when it rarely happened for me during the ELD-era I just added On-Duty, Not Driving (ODND) time to my ELD before beginning my current work day duties, let's call that "Monday" for this discussion. When I came in Monday morning, I would log into my ELD, edit the appropriate prior days' ELD entries to record the start & end times of the 2nd job. Nobody will hassle you about the start of your 2nd job work periods, but the end times will be important later, after some incident. You need to confirm you are getting 10 hours off-duty, not just recording 10 hors off-duty before you start your Monday CDL activities. If your CDL schedules depends on your getting a 34 hour reset, because of your circumstances, you will have to pay close attention you are getting a 34 hour reset and a 10 hour break before driving.
I don't believe the trucking company can prevent you from accurately recording your activity in the ELD. The company can fire you for having impure thoughts on a steamboat landing 6 weeks ago, if they want to make their point. The company cannot legally force you to approve false logs.tarmadilo Thanks this. -
Are you seeing the big picture yet, OP?
Because you choose to follow the rules you now have to report your time working your second job (no matter if it's a driving job or not.)
That means when you take your 10 hours you won't be able to meet your start time for your driving job.
If you work your non-driving job on the weekend it'll be nearly impossible to get your 34 without getting proper rest. So again, you'll miss your start time for your driving job.
Since you choose to follow a ridiculous rule you now will be losing time from your driving job and I bet they will fire you for it. They need you to be there and fresh for duty.

True but it would be impossible to prove whether he was fatigued or not. Anything else is a simple HOS violation.
