No, an asylum seeker is not an "illegal immigrant" by definition, as seeking asylum is a legal process under international and U.S. law. While an asylum seeker's initial entry into a country might be unauthorized, their presence is not considered "illegal" once they have applied for asylum. If their asylum claim is denied, they may then become removable from the country.

the person may still be able to appeal the decision in immigration court or with the Board of Immigration Appeals (BIA). They may also be able to seek other forms of protection, such as under the Convention Against Torture (CAT).
