today in class my instructor said that you didn't have to take a 30 min break at 8 hours of driving time he said the dot didn't really care about that and you could drive 11 straight hours or as close to 11 as you could get well I read somewhere at least I think I did that you had to have a 30 min break for 8 hours of driving im just wondering if what my instructor said was true about the dot not really caring about that lil 30 min break

The law states that you can not drive if more than 8 hours have passed since your last off duty period of 30 minutes or greater.

wait till you run across a dot that does care. the law states cant drive over 8 hrs without a 30 min break.

that what I told him maybe he just got lucky and never had to deal with it my feeling about it is it's only 30 mins use it for a bathroom break lol

This is the court ruling that would disagree with your instructor. The 8 hour break rule does not apply to trucks that only drive on short haul operations. Do not try the my teacher told me so defense.
On December 27, 2011 (76 FR 81133), FMCSA published a final rule amending its hours-of-service (HOS)
regulations for drivers of property-carrying commercial motor vehicles (CMVs). The final rule adopted
several changes to the HOS regulations, including a new provision requiring drivers to take a rest break
during the work day under certain circumstances. Drivers may drive a CMV only if 8 hours or less have
passed since the end of the drivers last off-duty or sleeper-berth period of at least 30 minutes. FMCSA did
not specify when drivers must take the 30-minute break, but the rule requires that they wait no longer than 8
hours after the last off-duty or sleeper-berth period of that length or longer to take the break. Drivers who
already take shorter breaks during the work day could comply with the rule by taking one of the shorter
breaks and extending it to 30 minutes. The new requirement took effect on July 1, 2013. -
That instructor needs to go to school himself or something. Thats not right, I wouldnt screw with it. DOT will care when you get your logs checked.

don't worry guys I'm not gonna screw with it I will take breaks when im supposed too I will try to aim for 7.5 of driving time tho then take it that way I can get 3 more hours of driving before it 10 hour break time
