45 minute safety rule

    I'm telling you their old log departments told them because of the 15 minute block formats and people rounding up/down a driver only has to be within 30min-45 min window. I had Barr-Nunn tell it to me when I was in their orientation way back when. When I asked the nice girl where in the regulations it allowed for wiggle room she informed me that log auditors had told the safety department this fact and it was widely known.

    To which I replied you better get the DOT on board because if you pull out of here(Charlotte at the time) and get checked at the south bound 85 scale(about 10 miles) where your book says you are still on your ten hour break for another 15 minutes in Charlotte when you hand it over he may have the driver wiggling a bit!

    There is no 45 minute safety coushion. If you run your 11's out because you waited 'till the last minute to park, you're SOL.

    "WIGGLE ROOM" - Noun - Another name for the sleeper berth where a driver goes to sit out his ten hour break after he has been placed out of service by DOT for being over his 14 hour rule or having a false log.:biggrin_2559:

    Thanks for posting that. I had searched previously and been unable to find that, so I was of the mistaken belief that the FMCSA did not define "emergency" (which I thought was a little strange). So, I have been corrected.

    The rule from FMCSA website: § 395.1Scope of rules in this part. (a) General. (1) The rules in this part apply to all motor carriers and drivers, except as provided in paragraphs (b) through (r) of this section. (2) The exceptions from Federal requirements contained in paragraphs (l) and (m) of this section do not preempt State laws and regulations governing the safe operation of commercial motor vehicles. (b) Adverse driving conditions. (1) Except as provided in paragraph (h)(2) of this section, a driver who encounters adverse driving conditions, as defined in §395.2, and cannot, because of those conditions, safely complete the run within the maximum driving time permitted by § 395.3(a) or § 395.5(a) may drive and be permitted or required to drive a commercial motor vehicle for not more than 2 additional hours in order to complete that run or to reach a place offering safety for the occupants of the commercial motor vehicle and security for the commercial motor vehicle and its cargo. However, that driver may not drive or be permitted to drive— (i) For more than 13 hours in the aggregate following 10 consecutive hours off duty for drivers of property-carrying commercial motor vehicles;(ii) After the end of the 14th hour since coming on duty following 10 consecutive hours off duty for drivers of property-carrying commercial motor vehicles;(iii) For more than 12 hours in the aggregate following 8 consecutive hours off duty for drivers of passenger-carrying commercial motor vehicles; or(iv) After he/she has been on duty 15 hours following 8 consecutive hours off duty for drivers of passenger-carrying commercial motor vehicles. (2) Emergency conditions. In case of any emergency, a driver may complete his/her run without being in violation of the provisions of the regulations in this part, if such run reasonably could have been completed absent the emergency.

    Shadow, I don't think that's what the drivers were referring to. If you read the post you quoted, you will see there is no mention of delays of any kind.

    I'm still waiting to see the explanation the driver gave for this.
