4.3.1.2. Vehicle Motion Status
(a) An ELD must automatically determine whether a CMV is in motion or stopped by comparing the vehicle speed information with respect to a set speed threshold as follows:
(1) Once the vehicle speed exceeds the set speed threshold, it must be considered in motion.
(2) Once in motion, the vehicle must be considered in motion until its speed falls to 0 miles per hour and stays at 0 miles per hour for 3 consecutive seconds. Then, the vehicle will be considered stopped.
(3) An ELD's set speed threshold for determination of the in-motion state for the purpose of this section must not be configurable to greater than 5 miles per hour.
(b) If an ELD is required to have a link to the vehicle's engine ECM, vehicle speed information must be acquired from the engine ECM. Otherwise, vehicle speed information must be acquired using an independent source apart from the positioning services described under section 4.3.1.6 of this appendix and must be accurate within ±3 miles per hour of the CMV's true ground speed for purposes of determining the in-motion state for the CMV.
'When in doubt go read the regulation. Asking truck drivers will get you a ton of wrong answers, mindless side debates, and lunch counter crap.

My ELD won't auto change logs to driving until I go 2 miles or something. It's looks like your driving Because the ELD has changed the display to the driving screen and it knows I'm driving. But I have 2 miles till it will actually go back and log driving. It also gives 30 second warning f I don't stop it will switch me to driving.
So I can go more then 5MPH I just have to stop before the 2 mile limit. I can drive a 2 miles down the road to another truck stop or across the street to get something to eat. The ELD does know I'm driving I just have 2 or 2.5 miles before it will switch me to driving. -
Breaks are for off duty, not delivering. Never understand people that choose to donate their time off. Disease of the industry. -

Put it in low and crawl. You shouldn't be driving off-duty anyways, so why are you trying to beat the system?

Gotta move the truck a short distance? ....LOGOUT....
It really is that simple, puts it on the company if anyone because if your not logged in it cannot put the time on you... So what happens?
A big red screen comes up and says....
VEHICLE IN MOTION STOP AND LOG IN
So this will work if your going less than 2 miles or so... Don't try it further than that or the company will get pissed.. It's what happens when you put your truck in the shop and they move it around.. Test drive and such... They don't log in for that. When you get where your going then just go off duty and log out...
