i work running locally. The terminal I'm out of never runs 7 days a week. We typically work 5 days a week, and rarely a 6th (only worked 6 days once since January). We were all under the assumption we were under the 7 day, 60 hour rule. The company I work for has several terminals, one of which runs 7 days a week. Their claim is that since one of their terminals runs 7 days a week, we are all under the 8 day, 70 hour rule. Anyone have any idea which one we fall under, and where I can find the info if we do in fact fall under the 7/60 one?

395 does specifically say "The motor carrier" when talking about the 60/70 rule. No mention about a specific terminal, so since one terminal works 7 days all the company should log for 70 hours. II'll post the link when I get home as my phone blows trying to link....

Reminds me of Class B tanker work hauling concrete in overtime 60 to 80 hours in 5 days flat including night time operations here in the heat of the summer day in Arkansas. If that clock is punched, we are still collecting over time pay even if we are snoring on the sand pile under the stars waiting for the call back.
I have never seen this question come up ever. Most companies take the 70 hours in 8 days. Why would they casterate themselves at 60 in 70 on the log book eh? -
